نظام إدارة الدعوى المدنية

Abstract

ان نظام ادارة الدعوى المدنية يقوم على أساس توزيع الأدوار ما بين قاضي الادارة وما بين قاضي الموضوع لغرض الفصل بين الوظيفة الادارية والوظيفة القضائية أثناء سير الدعوى. ان تراكم الدعاوى أمام المحاكم المدنية، بسبب تأخير الفصل بها تُعد من المسائل المهمة التي توليها السلطة القضائية أهمية كبيرة كونها تتعارض مع أهداف ومبادئ قانون المرافعات المدنية في تحقيق القضاء العادل العاجل، فلم تفلح زيادة عدد القضاة أو تحديد سقف زمني بغرض حسم الدعاوى، لذلك يستدعي البحث عن وسائل أخرى لتسوية النزاعات بطريقة ترضي جميع الخصوم و تحقق الهدف من تخفيف العبء عن المحاكم. وسيتم اتباع المنهج الوصفي التحليلي من خلال عرض تجربة بعض الدول التي أخذت بهذا النظام ومنها الاردن كنموذج يؤيد نجاح هذا النظام. وتوصلنا الى نتائج أهمها هو فصل الوظيفة الادارية للقاضي عن الوظيفة القضائية، وتبنينا مجموعة من الوصايا كان أهمها هو العمل بنظام ادارة الدعوى المدنية في المحاكم المدنية وتهيئة جميع متطلبات هذا النظام من مقرات وقضاة وموظفين اداريين بغية تعميم هذه التجربة ونجاح أهدافها . Abstract The civil proceedings management system is based on the distribution of roles between the administrative judge and the trial judge for the purpose of separating the administrative function and the judicial function during the course of the proceedings. The accumulation of cases before civil courts because of the delay in dismissal is one of the important issues that the judicial authority attaches great importance to، contrary to the objectives and principles of the Civil Procedure Law، in the achievement of an immediate and speedy judicial process. To seek other means of settling disputes in a manner that satisfies all adversaries and achieves the objective of reducing the burden on the courts. The analytical descriptive approach will be followed by presenting the experience of some countries that have adopted this system، including Jordan as a model that supports the success of this system. The most important of these results is the separation of the administrative function of the judge from the judicial function and the adoption of a series of wills، the most important of which is the civil case management system in the civil courts and the preparation of all the requirements of this system from headquarters، judges and administrative staff in order to disseminate this experience and the success of its objectives
