أحكام شركة الشخص الواحد في القانون السوداني (دراسة مقارنة)

Abstract

جاءت هذه الورقة البحثية بعنوان أحكام شركة الشخص الواحد في القانون السوداني، وتشتمل على ثلاث مباحث كل مبحث يتضمن مطلبين، وتجسدت المشكلة الأساسية للدراسة حول سؤال مفتاحي تتفرع عنه عدة أسئلة في محاولة للوقوف على حقيقة موقف المشرع السوداني من شركة الشخص الواحد، وتنبع أهمية الورقة من الناحية العلميه في أنها تثري الساحة القانونية بمبادئ جديدة بينما تنبع أهميتها من الناحية العملية في أنها تساعد أصحاب المشاريع الصغيرة والمتوسطة في تطوير أعمالهم دون الخشية من مخاطر المسؤولية المطلقة ثم أعقبت ذلك بخاتمة تتضمن العديد من النتائج والتوصيات وتجسدت أهم نتيجة في أن المشرع السوداني ظل على موقفه الرافض للتأسيس المباشر لشركة الشخص الواحد بينما سمح بتكوين نوعين منها بطريقة غير مباشر فكانت التوصية بتبني المشرع السوداني لشركة الشخص الواحد للاستفادة من مزاياها. Abstract: This study was entitled to the provisions of One Man Company in Sudan law and it include three fields each field include two requirement the basic problem of study is embodied about quality question branching off several question in an attempt to fine out the truth of the position of Sudan legislator from One Man Company. the importance of the study stems from the scientific point of view that it enriches the legal arenas by new principle while it’s importance in practice resolved in helping that they are supporting small and medium enterprises to develop their work without fear of unlimited responsibility risk. then followed up by conclusion including a lot of result and recommendation, that have been emphasized as the as the most important result that Sudan legislator on it’s positive position for the establishment of One Man Company by direct way while allowed to configure to type of the same company by an indirect way therefore the recommended that Sudan legislator adopt One Man Company to get it advantage.
