مَقَاصِدُ التَّشْرِيعِ الإِسْلَامِيّ مِنْ إِقَامَةِ حَدِّ الزِّنَا

Abstract

تناول هذا البحث موضوع مقاصد التشريع الإسلامي من إقامة حد الزنا وتُبيِّن دراسة هذا الموضوع أهمية إقامة الحدود الشرعية في ضبط الأفراد والجماعات والمجتمعات. وهدفَ البحثُ إلى تحقيق معرفة حد الزنا وبيان مشروعيته وتحريم مرتكبيه؛ وشروط إقامة الحد على الزاني ، وكيف يتمُّ إثبات جريمة الزنا مع بيان مقاصد التشريع الإسلامي من إقامة الحدود الحافظة للنسل والعرض. وسعى البحث للإجابة على السؤال التالي ما مقاصد التشريع من إقامة حد الزنا الحافظ للكليات الخمسة ؟ واعتمد الباحث في كتابة هذا البحث على المنهج الوصفي التاريخي التحليلي . اقتضت طبيعة البحث أن يقوم هيكله على مقدمة وأربعة مباحث وخاتمة وفهارس, ومن أهم نتائج البحث تَبيّنَ أن معرفة مقاصد الشريعة الإسلامية لها أهمية كُبرى للمُجتهد تُكسبه قوةً يفهمُ منها مُراد الشرع . ويمكِّنه من الإستنباط . والمجتمع الذي يتفشى فيه الزنا مجتمع مكتوب عليه الإنهيار, والزنا من الكبائر التي تفتك بالمجتمعات، لأن الزنا مفضٍ إلى الكثير من الجرائم ، إذ يهُزُّ كيان الأسرة ، ويسبب العار والشنار بهم ، ويسبب الكُره والبغض ، ويسبب الأمراض الخطيرة التي تفتك بالأبدان وتضر بالصحة ومقصد الشريعة الإسلامية من إقامة الحد على الزناة هو حماية الفضيلة ، وحماية المجتمع من أن تتحكم الرذيلة فيه .
