المسئولية الجنائية عن أوامر الرئيس في القانون الدولي الجنائي

Abstract

جاءت هذه الدراسة بعنوان: المسؤولية الجنائية عن تنفيذ أوامر الرئيس في القانون الدولي الجنائي وتبدو أهمية دراسة هذا الموضوع في أنه أحد أهم موضوعات القانون الدولي الجنائي التي لم تحظ باهتمام من الباحثين لاسيما على الصعيد الوطني. علاوة على ذلك أن أوامر الرئيس تمثل أعمال لمفهوم السيادة الوطنية حيث تهدف الدراسة إلى بيان التكييف القانوني لهذه الأوامر، والمسؤولية الجنائية عن تنفيذها بالإضافة إلى موقف التشريعات الوطنية ومن بينها التشريع السوداني من مسؤولية رئيس الدولة عن أوامره القاضية بارتكاب جرائم دولية. وتوصلت الدراسة لعدد من النتائج من أهمها إن تنفيذ أوامر الرئيس لا تغفي المرؤوس من المسؤولية الجنائية في حال تعلقها بالجرائم الدولية، كما أوصت الدراسة بعدد من التوصيات منها ضرورة أن تنص التشريعات الوطنية على المسؤولية الجنائية عن أوامر الرئيس المتعلقة بالجرائم الدولية. الكلمات المفتاحية: المسؤولية الجنائية – قانون الدولي الجنائي – السيادة الوطنية – الجرائم الدولية Abstract This study is entitled: Criminal responsibility for the implementation of the President's orders in international criminal law. The importance of studying this subject appears to be one of the most important topics of international criminal law which has not received the attention of researchers, especially at the national level. Moreover, the President's orders represent acts of the concept of national sovereignty. The study aims at clarifying the legal adaptation of these orders and the criminal responsibility for their implementation, as well as the position of national legislation, including Sudanese legislation, on the responsibility of the Head of State for his orders to commit international crimes. The study reached a number of results, the most important of which is that the implementation of the President's orders does not relieve the subordinate of criminal responsibility in the case of international crimes, the study also recommended a number of recommendations, including the need for national legislation to provide for criminal responsibility for the president's orders relating to international crimes.
