المشاكل التي تواجه المصارف السودانية في تطبيق الاعتمادات المستندية

Abstract

المخلص تناولت الدراسة المشاكل العملية في تطبيق الاعتمادات المستندية في البنوك المحلية ومراسليها وتركزت مشكلة الدراسة في عدم التزام المصارف المحلية بالقواعد والأعراف الدولية الموحدة للاعتمادات المستندية والتي تحفظ حقوق كل من الأطراف مما يؤدي إلى دخول المصارف في تعقيدات ومشاكل تؤثر سلباً على تنفيذ الاعتماد المستندي وبالتالي على مصالح المصدر والمستورد. وقد هدف البحث إلى توضيح الآثار الناتجة من عدم التزام المصارف بالأعراف ذلك عن طريق دراسة بعض الحالات العملية. وتوصلت الدراسة إلى الآتي: - ضروري الفهم الصحيح والدقيق للأعراض والقوات المنظمة للاعتمادات المستندية. - تقيد المصارف المحلية ومراسليها بما ورد من أحكام بالقواعد لتجنب الكثير من الأخطاء. - عمل دورات تدريبية دائمة لموظفي الاعتمادات المكتبية. - الاختيار الدقيق لموظفي الاعتمادات من حيث الخبرة، الدقة والحرص.

Abstract The study deal with the practical problems in the Documentary credits in the local banks and it’s correspondences. the study drew a conclusion that the problem was ultimately due to the complying banks with uniform customs customers and practice that is organizing the documentary credits, and which preserve the rights of all parties. This leads to complications and problems on the side of the banks, which in turn affect negatively the execution of the documentary Credits and therefore, the interests of the importers and exporter. The study aimed t highlight the results of the banks been none compliance of the banks with the UP500 1993 rules through studying practical cases. The study comes out with the following results: - The necessity of a correct and precise comprehension of the UCP rules that organizing the Documentary Credit. - The necessity of the compliance of the local banks and their correspondences with the UCP and its rules to avoid lot of mistakes. - Perform regular training and workshops o the Documentary Credits employees. - The accurate selection of employees for Documentary Credits according to their experience, accuracy and carefulness.
