عبد الملك آدم عمر عبد الله2019-10-272019-10-272019جامعة النيلينhttp://hdl.handle.net/123456789/14928بحث مقدم لنيل درجة الماجستير في القانونمستخلص البحث يتناول هذا البحث حق الاختصاص في القانون ويسعى البحث لتحقيق الأهداف التي تتمثل في التعرف على المشاكل والمعوقات التي تواجه حق الاختصاص في القانون، ومعرفة المنشورات والضوابط التي تخص حق الاختصاص، وتزويد الإدارات القانونية بالطرق الصحيحة لتطبيق حق الاختصاص في القانون، والتعرف على الآثار السالبة المتعلقة بحق الاختصاص. كما يهدف البحث لاختبار الفروض التي يحاول الإجابة عليها من خلال البحث وهي عدم تطبيق الضوابط والتوجيهات بالضمانات الصادرة بخصوص حق الاختصاص، المبالغة في التقييم بواسطة الخبراء لقيمة العقار والأرض يعرض المصارف لفقدان الموارد، التزوير في مستندات ملكية العقار وإجراءات التسجيل يعرض المصارف لمخاطر الائتمان، ولأجل ذلك استخدم الباحث المنهج الوصفي والتحليلي والاستنباطي المقارن لقانون حق الاختصاص من خلال استخراج النصوص, والمنهج التاريخي لتتبع عمليات الآثار السالبة والموجبة بحق الاختصاص. وخرج البحث بعدة نتائج وتوصيات نجملها في أنَّ السبق الذي يكون سبباً لحق الاختصاص تارة يرد على الأموال المنقولة، كما يرد على وضع اليد على المباحات العامة، وهو وإن كان لا ينتج ملكية خاصة بل غاية ما يتمخض عنه، حق اختصاص وأولوية. أن حق الانتفاع إذا صاحبه الاختصاص كان من الحقوق الخاصة، وقد يتجرد عن الاختصاص فيعتبر من الحقوق العامة، مثل الانتفاع بمرافق الأسواق والجلوس في المساجد ونحوها، و يشترك في ذلك جميع الناس، إلا أن من سبق إلى موضع منها كان وهو الأحق بها، وإن حق الاختصاص طريقة تسهل الانتفاع من موارد (الملكية العامة) بالقدر الذي يحقق الانتفاع لغرض إيجاد فرصة انتاجية جديدة، من خلال النتائج السابقة توصل الباحث إلى التوصيات التالية: النظر إلى المنشورات والضوابط التي تخص حق الاختصاص، ضرورة معرفة أهم المشاكل والمعوقات التي تواجه حق الاختصاص في القانون، الاهتمام بمعرفة التقييم بواسطة الخبراء لقيمة العقار والأرض يعرض للمصارف لفقدان الموارد، تزويد الإدارات القانونية بالطرق الصحيحة التي لها أثر في تطبيق حق الاختصاص في القانون. Abstract This research deals with the right of jurisdiction in law and research seeks to achieve the goals is to identify the problems and obstacles facing the right of jurisdiction in the law.
