هادية عطا علي البشير2021-06-142021-06-142020http://hdl.handle.net/123456789/16423بحث تكميلي لنيل درجة ماجستير القوانين بعنوان :مستخلص البحث عبر العقود الماضية لجأ الآلاف من اللاجئين في العالم إلى دول أخرى وكان السبب في هذا اللجوء عدد من العوامل السياسية والاقتصادية والطبيعية والبيئية بحثا عن الحماية والفرص لتحسين حياتهم المعيشية. وقد هدفت هذه الدراسة إلى التعرف على المعايير التي تحكم تعامل المجتمع الدولي مع قضايا اللاجئين الإنسانية وعكس صورة لدور المنظمات الإقليمية والدولية العاملة في مجال اللاجئين والأدوار التي تقوم بها من أجل حمايتهم وعكس مزيد من الاهتمام حول أوضاع اللاجئين في منطقة القرن الإفريقي. تم استخدام المنهج التاريخي والوصفي والتحليلي في هذا البحث . بذلك أمكن التوصل لعدد من النتائج منها معسكرات اللاجئين حاضنة لتجارة البشر وان اللاجئ لا يحظى بالحماية الكافية مما يجعله يقع فريسة في يد تجار البشر ، بعض الدول تضع عراقيل أمام استقبال اللاجئين وعدم سرعة البت أو تعقيد إجراءات طلب اللجوء كما أن المعايير الدولية لحماية اللاجئين أصبحت لا تتناسب مع التطورات في الساحة السياسية والدولية والمخاطر التي أصبحت تحيط بأوضاع اللاجئين وقد أوصت هذه الدراسة على تشجيع وتعضيد لنشر ثقافة السلام والبحث عن الحلول السلمية للنزاعات بين الدول للحد من ظاهرة اللجوء، تكثيف الحماية الدولية والإقليمية للنساء اللاجئات والأطفال وكبار السن لأنهم أكثر الفئات تأثراً بالنزاعات ويتحملون النصيب الأكبر في الأعمال الوحشية والنتائج الأخرى المترتبة على النزاعات المسلحة ، يجب التنسيق بين المفوضية السامية للاجئين وحكومات الدول المستقبلة لهم لإقامة مشروعات تنموية لاستيعابهم للعمل بها. وقد اشتملت الدراسة على ثلاثة فصول ، تناول الفصل الأول الإطار النظري الذي اشتمل على مفهوم اللجوء وتعريف اللجوء ، والفصل الثاني تناول أسباب اللجوء وحقوق اللاجئ ، والفصل الثالث والذي جاء مشتملاً على دور المنظمات الإقليمية والدولية في حماية اللاجئين، ثم اختتمت الدراسة بمجموعة من التوصيات والنتائج وأخيرا المراجع. ( د ) Abstract Over the past decades , thousands of refugees all over the world transferred to other countries , and the cause of migration refer to some factors , political factors , economical , natural and environmental factors looking for protection and opportunities to improve their life situation. This study targeted to acknowledge about the main standards which govern the global community dealing with the refugees issues and to offer the humanitarian needs to them and to shift a light on the roles of the local and international organizations working in the field of refugees issues to protect refugees in the horn of Africa. The researcher follows the historical , predictive and analytic methods in this study. The researcher concluded to some results and recommendations. The main result is that , the refugees camps were the nursemaid and the home of human trafficking and due to the lack of perfect protection and care , so they fall in the hands of human trafficking hands. Some countries make difficulties and obstacles when they receive the refugees by slowing the procedures of entering their countries .Also the global standards were not quite enough to protect the refugees and are not suitable for the development of the global political field and the risks that surrounds the refugees situations. The study reached to some recommendations such as Making intensive importance to refuges protection measures. Searching for the main causes of refugees and immigration factors and solve them – the civil settlement of the conflicts between the countries . Encourage peace culture and peaceful solution for conflicts between countries to minimize refugee phenomenon by diversification of local and international protection for women and infants and elderly men because they are more affected persons and more subjected to demonic attacks and armed conflicts. Coordination should be made between the high commission of refugees and the receiving countries to establish developmental projects to employ them. The study composed of these chapters . Chapter one discussed the theoretical approaches of the refugees conception .Chapter two examines the main causes of refugees , refugee rights. Chapter three composed of the role of the international and the regional organizations to protect refugees .
