حيدر قاسم فتيني شنيني2018-02-192018-02-192018http://hdl.handle.net/123456789/11006رسالة مقدمة لنيل درجة الدكتوراه في القانون الدوليمستخلص تناولت الدراسة الحماية القانونية لبيئة البحر الأحمر وخليج عدن من التلوث، وأبانت الدراسة مشكلة التلوث البيئي لكليهما من الناحية القانونية وتطبيقها على الواقع. هدفت الدراسة إلى بيان موقف القوانين والتشريعات الوطنية والإقليمية والدولية من عملية التلوث للمصادر المائية لاسيما التلوث النفطي والنفايات المشعة من خلال التخلص منها في أعالي البحار. اتبعت الدراسة المنهج الوصفي والتحليلي باعتبارها دراسة قانونية تحتاج إلى تحليل ووصف المشكلات البيئية والمخاطر التي تهددها بالإضافة الى المنهج المقارن حيثما تطلب ذلك. نبعت أهمية الدراسة من أهمية حماية بيئة البحر الأحمر وخليج عدن للحد من مخاطر التلوث البيئي والوقوف عند أسباب الأزمة البيئية. وأبانت الدراسة بعضاً من أسباب التلوث لبيئة البحر الأحمر وخليج عدن، منها رمي النفايات الصناعية والمخلفات النفطية. وتوصلت إلى عدد من النتائج أهمها: تراكم المخلفات المختلفة وتآكل الشواطئ واندثار الكائنات الحية الساحلية والزيادة السريعة في فقدان التنوع الحيوي الساحلي والاستخدام المفرط للموارد واستنزافها، وتتميز المنطقة الساحلية لمحافظتي الحديدة وعدن بتوافر بيئات شاطئية بحرية غنية بالتنوع الحيوي الكبير ديناميكياً. وخرجت الدراسة بتوصيات أهمها: تفعيل التشريعات سواء على المستوى الدولي أو الإقليمي أو الوطني حتى تؤتي ثمارها وتحقق الغاية المرجوة منها وذلك لمعالجة أوجه القصور فيها، ورفع مستوى الوعي بين الأطراف المعنية، وإيجاد آليه تتضمن التقيد بهذه التشريعات، وضرورة الحفاظ على التنوع الحيوي للأحياء البحرية في البيئات المختلفة وإيقاف أي تجاوزات على هذه المواقع الهامة بما يحفظ التوازن البيئي والتنوع الحيوي القائم، وتفعيل جهود الشرطة الساحلية، ورجال الضبطية القضائية، وتوفير الإمكانيات المادية والقانونية للجهات الأمنية ذات الصلة بالبيئة البحرية، وضرورة رفع مستوى الوعي البيئي، وإشراك المجتمع في الدفاع عن البيئة البحرية، وتعميق ونشر التوعية البيئية بأضرار التلوث البحري عبر وسائل الإعلام المختلفة كالصحف، المجلات، التلفاز والإنترنت. Abstracts This study came under address the legal protection for environment of the Red Sea and Gulf of Aden, This study was treatment problem of the environmental pollution of the red sea and Gulf of Aden. international laws, and regional legislation and legislation of the countries of the region to protect the environment of the Red Sea and Gulf of Aden from pollution process whether oil pollution or the waste of radiation by put in the upper oceans. This study followed the description & analysis methods by its concentration the analog legalization studded its need analyses and describe of the problems and risky of environmental that it’s threatening. So this study included three chapters treatment her topics it’s integrally. This study abstracted the most important findings by numerous of results and recommendations reached by the researcher in this study to a number of environmental problem, and pressures on the coastal zone and its environment and its impact on marine and human life. The study showed some of the causes of the environmental pollution of the Red Sea and Gulf of Aden environment including: accumulation of various wastes, coastal erosion, depletion of coastal organisms, the rapid increase in loss of coastal biodiversity and excessive use and depletion of resources. The provinces of Hodeida and Aden coastal area are characterized by the availability of marine beach environments, rich in biodiversity great dynamic. Among the recommendations that going by the study: Activation whether on the level of legislation international, regional or patriotic until achieve its objectives, for treatment dials of shortcomings, raise level of awareness among the concerned parties and to find mechanism to comply with this legislation, And necessaries to preserve the biodiversity in different habitats environments and to stop any transgressions on these important sites by preserve the ecological balance and the existing biodiversity. Activating the efforts of the coastal police, judicial control personnel and providing the abilities of material and legal resources for the security authorities related to the marine environment.
