سيف الدين الأمين أمبده ابو دور2020-10-202020-10-202019http://hdl.handle.net/123456789/15967بحث لنيل درجة الدكتوراه في القانونمستخلص جاءت هذه الدراسة بعنوان دور المحكمة الدستورية في حماية الدستور والنظام القانوني للدولة. تناولت الدراسة المحكمة الدستورية من حيث تشكيلها واختصاصاتها وسلطاتها كما تناولت بصورة خاصة دورها في حماية الدستور والنظام القانوني للدولة من خلال دورها في مراقبة دستورية القوانين وفق آليات الدعوي الأصلية والدفع الفرعي. اهتمت الدراسة بدور المحكمة الدستورية في حماية الدستور والنظام القانوني للدولة لما لهذا الدور من تأثير على وجود الدولة القانونية وحمايتها وتكريس مبدأ حكم القانون. اعتمدت هذه الدراسة استخدام المنهج الوصفي والتحليلي والمقارن وذلك لوصف وتحليل النصوص التي أوردها المشرع الدستوري عن دور المحكمة الدستورية في حماية الدستور والنظام القانوني للدولة في الدستور السوداني اضافة لمقارنة ذلك بالأنظمة المقارنة. هدفت هذه الدراسة إلى الوقوف على مرتكزات دور المحكمة الدستورية في حماية الدستور والنظام القانوني للدولة وحدود هذا الدور. استنتجت الدراسة أن للمحكمة الدستورية دور مزدوجاً فهي من ناحية تعد جهة للقضاء الدستوري لمراقبة دستورية القوانين وهي من جهة ثانية تعتبر محكمة جنائية خاصة لمحاكمة رئيس الدولة عن جريمة الخيانة العظمي وجرائم أخري توصي الدراسة بمراجعة قانون المحكمة الدستورية لسنة 2005م وإلغاء النصوص التي تعطي المحكمة اختصاصاً جنائياً. Abstract This study is entitled the role of the Constitutional Court in the protection of the Constitution and the legal system of the State. The study dealt with the Constitutional Court in terms of its composition, powers and powers, in particular, its role in protecting the Constitution and the legal system of the State through its role in monitoring the constitutionality of laws according to the original lawsuit mechanisms and subpayment. The study focused on the role of the Constitutional Court in protecting the Constitution and the legal system of the State because of its impact on the existence and protection of the legal state and the establishment of the principle of the rule of law. This study adopted a descriptive, analytical and comparative approach to describe and analyze the texts reported by the Constitutional Legislator on the role of the Constitutional Court in protecting the Constitution and the legal system of the State in the Sudanese Constitution in addition to comparing it with comparative systems. The purpose of this study is to identify the foundations and limits of the role of the Constitutional Court in protecting the Constitution and the legal system of the State. The study concluded that the Constitutional Court has a dual role, on the one hand, it is considered as a body of the constitutional judiciary to monitor the constitutionality of laws. The study recommends that the Constitutional Court Act of 2005 be revised and the provisions giving the court criminal jurisdiction be repealed.القانون للدوليالمحكمة الدستوريةحماية الدستورThesis
