ملخص الدراسة

عني هذا البحث بواحد من المواضيع المهمة ذات الصلة بالمجتمع الا وهو الزواج بالتراضي بين الفقه الإسلامي والقانون ، حيث تطرقت فيه الى بيان أهمية ركن الولي في الزواج انطلاقاً من النصوص الشرعية وأقوال الفقهاء في وجوب إعتباره في عقد الزواج حيث استعرضت فيه موقف الفقه الإسلامي بمذاهبه الأربعة، و موقف القانون السوداني. وقد تناولت فيه مفهوم الزواج وأركانه وشروطه بصوره عامه ثم تحدثت عن الزواج بالتراضي بصفة خاصة و مفهومه وحكمه واثره الشرعي والقانوني ثم تحدثت عن مفهوم الولاية وشروطها وأقسامه وغياب وعضل وسقوط الولاية، وولاية القاضي وزواج القاصر والقاصرة ثم تناولت في ختام البحث أهم النتائج والتوصيات التي توصلت اليها.

Abstract This research concerned with one of the significant social subjects, which is the civil marriage between Islamic jurisprudence and the law. Where it dealt with an explanation of the importance of the guardian's marriage pillar, based on the Quran and the jurists' statements that "he should be considered in the marriage contract" I examined the Islamic jurisprudence situation, which is the consensual marriage between Islamic jurisprudence and the law. Where it dealt with an explanation of the importance of the guardian's pillar in marriage, based on the Quran and the sayings of the jurists that” he should be considered in the marriage contract” I, reviewed the situation of Islamic jurisprudence with the four doctrines and the situation of Sudanese law. I address the concept of marriage, its pillars, and conditions in general terms, then about consensual marriage particularly it is concept and the judgment and it legal and notarial influence, then he talked about the concept of guardianship, its conditions and divisions, unseen, prevent and Forfeiture of guardianship, the guardianship of the judge and the marriage of under age. Therefore I addressed the relevance of the conclusions and suggestions that I have made at the conclusion of the study.
