الإعسار المدني للمدان جنائياً

Abstract

مستخلص البحث يعالج هذا البحث الدفع بالإعسار من المدان جنائياً بعد إنقضاء فترة العقوبة وطلب المحكوم له التنفيذ بالقبض علي المدان في الفقه الإسلامي والقانون السوداني ، وتتبع أهمية هذا البحث من إنتشار ظاهرة الدفع بالإعسار أمام المحاكم المدنية . ولتحقيق أهداف هذا البحث إستخدم الباحث المنهج الإستقرائي الوصفي والتحليلي أملاً في الوصول إلي الحقائق العلمية . وقد تناول البحث مفهوم الإعسار والإدانة كتمهيد لهذه الدراسة ، كما تناول المقارنة بين الإعسار المدني والإفلاس التجاري ، بالإضافة لإطلاق سراح المدان جنائياً للإعسار. وقد أظهرت نتائج البحث علي أن الدفع بالإعسار يجوز في جميع أنواع الديون في القانون السوداني . وتنعكس النتائج التي أسفر عنها البحث بتعديل نص المادة 244 من قانون الإجراءات المدنية السوداني لسنة 1983م وذلك بإضافة فقرة تنص علي إطلاق سراح المدان جنائياً طالما سقطت الإدانة الجنائية وتم حسب المدان جنائياً بموجب قواعد القانون المدني .

Abstract

This research dealt with the payment of the civil inso levency of criminal convicted person after the expiry of sentence and the demant of convicted person to arrest the convicted person in the Islamic jurisprudence and the Sudanese law and,the importance of this research emanates of form spread of the dayment of civil clvency phenomenon civil court. For achiving the objectives of this research the rescarcher used the analstic inductive approach hoping to reach at authentic scientific facts. The research has dealt with the concept of the insolvency and the convictment as introductory chapter of this research , and also dealt with the comparsion between civil insolvency and bankruptcy in addition to re elease of criminal convicted person because of insolvency. The results showed that the payment of insolvency is possitle in all types of civil debts in Sudanese law. The results of the research to coment the article (244) of civil procedures law of 1988 by adding aparagraph stating that the criminal convicted person shoud be released , after finishing the criminal penalty.
