حق التتبع واثره علي مركز الحائز

Abstract

مستخلص الدراسة هذه الدراسة جاءت بعنوان (حق التتبع وأثره على مركز الحائز) والتي قسمت الى أربعه فصول يسبقها فصل تمهيدي وتكمن أهمية هذه الدراسة في أن حق الرهن التأميني لا يفقد الراهن حقه في ملكية العقار وما يتفرع من هذه الملكيه (إستعمال ، إستغلال ، تصرف) كما هو شائع أو ممارس في الواقع العملي ، لذا جاءت هذه الدراسه لتلقي الضوء على هذا الحق ، وكان تقسيم هذا البحث على الوجه التالي فقد تناولت في فصله التمهيدي مفهوم الرهن من حيث المعنى والنشأه وشروط تكوينه ، وفي الفصل الأول تناولت ماهية حق التتبع وشروطه وكيفية مباشرته ، ثم مفهوم الحائز وحقوقه في الفصل الثاني ، وأفردت الفصل الثالث لخيارات الحائز من قضاءٍ للديون وتطهيرٍ للعقار وتخليته ثم تحمل اجراءات نزع الملكية . واخيراً جاء الفصل الرابع بعنوان الآثار المترتبه على مباشرة حق التتبع من حيث رسو المزاد على الحائز وعلى غير الحائز ورجوع الحائز على المالك السابق والمدين ثم مدى امكانية رجوعه على الكفيل . وختاماً أوردت بعض النتائج التوصيات التي توصلت لها من خلال البحث والتي نأمل في ان تجد طريقها للتطبيق وأن تعين الباحثين في دراستهم المستقبليه.

Abstract This study is entitled "The Right of Dependence and its Impact on the Status of the Holder", which was divided into four chapters preceded by a chapter The importance of this study is that the right of a full mortgage does not lose the right of ownership of the property and what branches of this property (use, exploitation, disposal ) In the preliminary chapter, I have dealt with the concept of foreclosure in terms of meaning and origin and the conditions of its composition. In the first chapter I dealt with the nature of the right to trace and its terms and how to proceed, The concept of the holder and his rights in the second chapter, and a The third chapter and we mentioned the holder options eliminate of debt and clearing the estate and then endure the expropriation procedures. Finally, the fourth chapter entitled the effects wich direct on the right of holder in terms of anchoring the auction to the holder and non-holder and the holder return to the owner of the former owner and debtor and then the extent of the possibility of returnung to the sponsor. In the end, we mentioned some of results through the research also we mentioned some recommendations hoping to find their way to be appled and to help the researchers in their future studies
