جرائم الإعتداء على النفس والمال والعرض فى ضوء الكتاب والسنة

Abstract

المستخلص باللغة العربية:

تناول هذا البحث موضوعا من موضوعات مهمة ألا وهو موضوع " جرائم الإعتداء على النفس والمال والعرض فى ضوء الكتاب والسنة " الذى يشغل العالم فى الوقت الحالى.

اتبع الباحث فى تقسيم هذا البحث الأساليب والتقسيمات المألوفة. فقسم البحث إلى أربعة أبواب بالإضافة إلى المقدمة تناول الباب الأول جرائم الإعتداء على النفس ويتضمن فيه التمهيد وثلاث فصول. ففى الفصل الأول ناقش الباحث عن القتل وعقوبته، وفى الثانى القتل الخطاء وموجبه، وفى الثالث القتل شبه العمد وعقوبته.

ناقش الباب الثانى جرائم الإعتداء على المال، ويشمل فيها على فصلين. ففى الفصل الأول ناقش الباحث عن جريمة السرقة وعقوبته وفى الثانى عن جريمة الحرابة وعقوبته.

أما الباب الثالث فقد ناقش جرائم الإعتداء على العرض، ويشتمل فيها على فصلين : يتكلم فى الأول عن جريمة الزنا وعقوبته وموانع التنفيذ وأفضلية الإستتار. وفى الثانى عن جريمة القذف وعقوبته.

أما الباب الرابع فقد استعرض عن مكافحة الإجرام عند علماء الشريعة وقد ناقش فيها عن دور الأخلاق فى حماية النفوس على فعل المنكرات ونماذج من مكافحة الشريعة للجريمة.

وقد عالج الإسلام الجرائم قبل ان تفحل وتنتشروقبل أن تكون داء بين الأمم، ولا ريب أن التطور الهائل الذى أصابته البشرية فى القرن العشرين، وبما حققتها فى ميدان الحياة وفى التكنولوجيا المعلومات المرئيات فيها والمسوعات لها تأثير كبير على أسلوب التعامل والتحايل للخروج على القانون لتجعل قوى الباطل فى الصدارة ولتنعكس سلبا على المسلمين بمبررات شتى الذى لا اساس له من الصحة . فقد أباحوا إراقة دماء المسلمين بدعوى الشيطانية مع أن للنفس من قيمة وكرامة فلا يجوز العبث بها ولا قتلها .

وبجانب ذلك فقد حافظ ديننا الإسلامى الحنيف على العرض والمال والنسب والعقل فلا يجوز لأحد أن يستهتر أو يعبث عليه وقد حمى الشريعة بالعقوبة على كل من يتطاول عليها أو ينال حرمتها .

وإذا كان العالم فى عصره الحديث ينادى بالإنسانية وحقوقها ويبطس بيد من حديد على كل من خرج عن القانون فإنه قصره على أناس وأجناس معينة دون أخرى بمبررات سافلة، مع أن الإسلام لا يفرق بين حقير وكريم فى تطبيق شريعته فكلهم سواسية أمام القضاء والقانون. فقد قال رسول الله 0 فى حديثه المشهورة ما رواه الشيخان في صحيحه عن عائشة، (... أيها الناس ! إنما أهلك الذين قبلكم، أنهم كانوا إذا سرق فيهم الشريف تركوه، و إذا سرق فيهم الضعيف أقاموا عليه الحد، و ايم الله ! لو أن فاطمة بنت محمد سرقت لقطعت يدها) (1).

ولو اتبع الناس هدى الله لهم لعاشوا بفضل الله فى بر موصول وخير ممدود وأمان فى عيشهم الدنيا والآخرة. وهذه الرسالة تفتتح ببسم الله الرحمن الرحيم وتختتم بحمد الله رب العالمين.

this reserch investigates an importen theme that has been occupying the world this time.e.g. Crimes of killing, property and honor in the frame of the holy book of Quran and Sunna.

The researcher has followed the familiar method of classifying this research into four chapters besides the introduction.

The first chapter focused on crimes of killing it includes a preface and three paragraphs. Paragraph one discussed killing and punishment, Pragraph two discussed unintentional killing. Pragraph three discussed the intentional killing and punishment.

In chapter two, the researcher discussed the crimes of property. This issue was divided into two sections in which he investigateed both crimes againt property, rubbery and its punishment.

In chapter three the researcher discussed crimes about honor and this includes two sections, the first section discussed the crime of illicit sex, its punishment and preferring of not disgracing . While second section discussed the criminality of accusation of making sexual fornication and its punishment.

In chpter four, the researcher extended the struggle against criminality in the new of Ulama, “Islamic Law Scientists”, as he discussed the role of ethics in self protection to avoid doing bad things and models of Syariah struggle againt criminality.

Islam gave a treatament to stop crimes before they spread and become a disease among nations. And there is nodoubt that the great progress achieved during the twenteeth century in the field of varions aspects, tehnology audio visual has a major effect on the dealings among people and other attempts to break the law to make what is wrong proper and true so that it reflects negatively on Moslems with varions reasons.

In addition, we should mention that Islam Religion is keen to protect lots of issues like honor, property and mentality.

Accordingly, no one is allowed to ignore or neglect these issues. Worthsaying that Islam protected Syariaa (Islamic Law) by punishing whoever dare to misuse it.

Nowadays people call for humanity will a claim to protect human rights and punish severly who exceeds the limits orbreak the law discriminating between certain people and races without any prior reasons while on the other side, Islam has never been discrimating people in applying syariaa or islamic orders. All people are equal in the eye of Islamic law. For instance, prophet Mohammad (May Allah’s prayers and peace be upon him) said in his famous Hadith, I suare that if even my higly daughter Fatima has Stolen something I would have applied the islamic law on her by cutting her hands.

So, if people follow God’s guidance and orders, they would live happy and safe. At last, we come to end of our research. We began with the name of God the most merciful anf finally end by tanking to God of the whole universe.
