المبادئ العامة لوضع الدساتير وتطبيقها على الدساتير السودانية

يتناول الباحث في البحث طرق وضع الدساتير عامة مقارنة مع دساتير السودان، وبما أن الدستور هو أهم وثيقة لتنظيم شتى نواحي الحياة الاقتصادية والسياسية والاجتماعية، جاء البحث متناولاً تلك الطرق في أربعة فصول على النحو التالي:

جاء الفصل الأول متحدثاً عن المبادئ العامة للدستور من حيث التعريف والأنواع والمصادر والتطور التاريخي لطرق وضع الدساتير.

أما الفصل الثاني قد تناول الطرق غير الديمقراطية لوضع الدساتير والمتمثل في أسلوب المنحة وأسلوب التعاقد من حيث الأهمية ومساهمتها نحو الاتجاه إلى الديمقراطية، كما تناول الفصل الثالث الطرق الديمقراطية لوضع الدساتير والتي تشمل أسلوب الجمعية التأسيسية والاستفتاء الدستوري أو الشعبي والكيفية التي تتم بها تلك الطرق وأمثلة لتلك الدساتير على المستوى العالمي.

أما الفصل الرابع والأخير؛ جاء البحث متناولاً دساتير السودان المختلفة منذ دستور الحكم الذاتي لسنة 1953م حتى دستور 2005م الانتقالي مروراً بكل الأنظمة التي حكمت السودان الديمقراطية والعسكرية متطرقاً للجوانب الايجابية والسلبية لتلك الأنظمة.

ثم طرق وضع الدساتير مقارنةً مع الطرق العامة، وجاءت الخاتمة شاملةً النتائج والتوصيات.

Abstract

The researcher takes up within this research “ways of drafting constitutions in general comparing with Sudan’s constitutions.

As it is clear that, the constitution is the important paper in all filed of Economic, Political and social life, the research discussed all these ways in four chapters as follow:

The main subject in the First chapter tackling the general principals of the Constitution from the aspect of Definition, Types, sources, historical development for phases drafting the constitutions.

Second chapter discussed the non-democracy ways to drafting out the constitutions, which represented in styles of granting, and contracting from its essential side of its contribution towards Democracy.

We detailed in chapter three the democratic ways for Drafting out Constitutions, which involved people assembly. Constitutional or public referendum and how to complete these ways, beside we gave symbols for those constitutions at the world level.

The fourth chapter, and the last one, reviewed the different Constitutions of Sudan, since the constitution of Self-Rule for the Year of 1953 up to constitution of 2005, through which we mentioned all the Democratic, and non-democratic regimes that governed Sudan, within this; positive and negative sides for these regimes were identified beside, ways of how to drafting out theses constitutions comparing with the General Ways.

My conclusion contained the Results and Recommendations
