الانحراف بالسلطة وأثره على مشروعية القرار الإداري(دراسة مقارنة)

Abstract

المستخلص يعتبر الانحراف بالسلطة ذو اثر كبير علي سير عمل الإدارة اذ انه يمثل خروجاً علي مبدأ المشروعية المفترض توافرها في القرار الإداري وبالتالي يمس حقوق الافراد وحرياتهم وذلك لإرتباطه بالغاية من اصدار القرار. تناولت الدراسة موضوع الانحراف بالسلطة واثرها علي مشروعية القرار الإداري وذلك بمناقشة مفهوم وصور وحالات عيب الانحراف بالسلطة واثر اثباته وتم الاعتماد علي المنهج الوصفي التحليلي وكان ذلك في ثلاثة فصول ، الفصل الاول تحدث عن الاحكام العامة لعيب الانحراف بالسلطة ، وفي الفصل الثاني صور الانحراف بالسلطة ، وفي الفصل الثالث أثر اثبات عيب الانحراف بالسلطة بغرض الإجابة علي التسؤلات التي ظهرت من خلالها مشكلة البحث والتي أهمها ماهي الكيفية التي يؤثر بها الانحراف بالسلطة علي مشروعية القرار الإداري وماهي الطبيعة القانونية لهذا العيب ومن ثم توصلت الدراسة الي مجموعة من النتائج برزت من خلال الإجابة علي التساؤلات التي طرحتها مشكلة البحث وتبعتها توصيات من اهم هذه النتائج ان الانحراف بالسلطة يؤثر علي مشروعية القرار الإداري وذلك بإلغاء القرار الإداري الذي كان يفترض صحته وهذا ما يؤدي الي اهتزاز الثقة لدى الافراد كما ان من النتائج ان عدم وجود قضاء اداري مستقل في دول القضاء الموحد أدى الي صعوبة اثبات عيب الانحراف كانت هذه أهم النتائج تبعتها اهم التوصيات وهي متمثلة في انه لابد من معالجة الانحراف بالسلطة بصورة رادعة وذلك بتوقيع اقصى عقوبة علي مصدر القرار الذي صدر انحرافاً بالسلطة حتي يكون ذلك رادعاً لمن تخول له نفسه ذلك ثم توصية أخرى وهي انه لابد من انشاء قضاء اداري مستقل يمثل البنة الأولى لمجلس الدولة السوداني. Abstract The deviation in power has a significant impact on the functioning of the administration as it represents a departure from the principle of legality that is supposed to be available in the administrative decision and thus, affects the rights and freedoms of individuals, in order to be linked to the purpose of issuing the decision. The study dealt with the deviation of the authority and its impact on the legitimacy of the administrative decision by discussing the concept, images and cases of defect of deviance in power and the effect of proving it for the purpose of answering the questions that emerged through the research problem, the most important of which is how the deviation affects the authority of the legitimacy of the administrative decision and what is the legal nature of this defect and then The study reached a set of results which emerged by answering the questions posed by the research problem by following the descriptive method. The recommendations of the most important of these results were that the deviation in the authority affects the legitimacy of the administrative decision by canceling The administrative decision that was supposed to be correct and this leads to the vibration of confidence in individuals and the results that the absence of an independent administrative judiciary has made it difficult to prove the defect of deviation were the most important results followed by the most important recommendations is that the need to address the deviation in power deterrent by signing The maximum penalty for the decision maker, which was deviated from the authority to be a deterrent to the authorizes himself and then another recommendation is that it must be the establishment of an independent administrative court, which represents the first step to the Sudanese State Council.
