التحقيقـات الجنائيــة المشـتركــة حول الجريمة المنظمة عبر الوطنية

Abstract

مستخلص البحث شغلت ظاهرة تنامي إنتشار الجريمة المنظمة عبر الوطنية وتعدد صورها المجتمع الدولي بصفة عامة وأصبحت أخطارها تهدد منظومة ذلك المجتمع على المستوى الوطني والدولي مما جعل مهمة التصدي لهذا النوع من الجرائم يجد إهتماماً متعاظماً وتعاوناً كبيراً بين الدول والمنظمات الدولية وسائر أشخاص المجتمع الدولي. لا تقف إستراتيجية مكافحة الجريمة المنظمة عبر الوطنية على حدود أعمال المكافحة والوقاية من وقوع مثل هذه الجرائم فقط بل يحتاج الأمر إلى تنشيط الجوانب الكشفية عما يقع منها من جرائم والسعي لإلقاء القبض على الجناة ومحاكمتهم وتوقيع العقوبات عليهم، ومن هنا تبرز مشكلة هذا البحث حيث يتطلب ذلك إجراء عمليات التحقيق والبحث الجنائي بصورة دقيقة ومتخصصة، وتشترك فيها أجهزة مختلفة قد يمتد نطاق اختصاصها الى خارج حدود الدولة. ويواجه مثل هذا النوع من التحقيقات بكثير من العقبات والصعوبات المتمثلة في الحدود السياسية للدول وحدود الولاية القضائية للتشريعات الجنائية التي تحكم عملية التحقيق. يهدف البحث الى التأكيد أن التحقيقات الجنائية المتعلقة بالجرائم العابرة للحدود الدولية تتطلب قدراً كبيراً من التعاون والمرونة لتجاوز تلك العقبات. من النتائج التي أفرزها هذا البحث أن هناك ضرورة لقيام فرق مشتركة من الدول المختلفة لتولي مهمة التحقيق، مع أهمية أن تتوفر لهذه الفرق كافة المساعدات القانونية الممكنة والخبرات المتخصصة والدعم الفني وغطاء من الشرعية القانونية لانجاز مهامها. يحتاج مفهوم التحقيقات الجنائية المشتركة حول الجريمة المنظمة عبر الوطنية إلى مزيد من تسليط الضوء حتى يتضح ويرسخ ويصبح عقيدة مشتركة لدى أفراد المجتمع الدولي، لذلك يوصي الباحث بإجراء الدراسات والبحوث والتطبيق العملي المستمر لهذا النوع من التحقيق حتى يؤتي هذا العمل ثماره نجاحاً في أعمال المكافحة واماطة اللثام عن عصابات الإجرام المنظم والكشف عن أعضائها تمهيداً لمعاقبتهم.

Abstract

The international community is interesting in the growing phenomenon of transnational organized crime and its types which threatens both national and international community and the difficulty of meeting such crimes draws attention and great collaboration between States, international organizations and all community members. The strategy of combating transnational organized but crime never stops in combating and protection processes, it needs to activate protection processes to detect the parts of crimes that took place and go forward to arrest the offenders, prosecute them and impose penalties, the thing which demonstrates the research problem that requires conducting accurate interrogation and criminal investigations in collaboration between different organs to extend their job behind the state border. This type of investigations faces some sort of obstacles and difficulties as well as States' political borders in addition to the jurisdiction of criminal legislation which rules the investigation process. The research is aiming at confirming that transnational crimes require collaboration and flexibility to overcome obstacles. Results of research resulted in the significance of forming States' joint teams to carry out investigations with full aid of legal and technical support in addition to specialized expertise and legal cover to fulfill their job. It needs to cast light on the concept of joint criminal investigations into organized transnational crime so that it becomes clear and common faith for the international community members wherefore the researcher recommends conducting studies, researches and practical applications of this type of investigations in order to achieve success in the process of combating and detecting of organized crime gangs in preparation for their punishment.
