ملخص البحث

هذا البحث ناقش موضوع الأحكام الفقهية الواردة في باب الجنايات في سورة المائدة دراسة مقارنة وهدف البحث إلى جمع ودراسة وتحليل أقوال الفقهاء والعلماء في باب الجنايات الواردة في سورة المائدة وتمثلت مشكلة البحث في السؤال التالي ما الأحكام الفقهية الواردة في سورة المائدة في باب الجنايات وسلك الباحث المنهج الاستقرائي التحليلي واقتضت طبيعة البحث أن يقوم هيكله على مقدمة وثلاثة فصول وخاتمة جاء الفصل الأول في التعريف بسورة المائدة وبيان أسباب نزولها وفضلها ومقاصدها وتناول الفصل الثاني مفهوم الجنايات وبيان أنواعها وتم في الفصل الثالث دراسة الأحكام الفقهية الواردة في باب الجنايات في سورة المائدة وتوصل البحث لعدة نتائج منها الجناية هي الذنب والجرم وما يفعله الإنسان مما يوجب عليه القصاص والعقاب في الدنيا والآخرة والجناية بصفة عامة نوعان جناية على البهائم والجمادات وتبحث عادة في باب الغصب والإتلاف وجناية على الإنسان الآدمي وانفردت سورة المائدة بالعديد من أنواع الجنايات مثل الحرابة والسرقة والقتل والخمر ومن توصيات البحث العناية بدراسة موضوع الجنايات لما له من أهمية كبيرة في أبواب الفقه الإسلامي وخاصة بعد تفشي أسباب الجناية وصورها في هذا العصر وضرورة تبصير الشباب والطلاب بأخطار الجنايات وما يترتب عليها عبر المؤتمرات والمحاضرات والندوات والدراسات والبحوث .
