رابع الأدلة الأصـولية

Abstract

هذه الدراسة الاصوليه تناول فيها الباحث ماهية الدليل الرابع من الأدلة الاصوليه الذي اختلف فيه مابين القياس والاستصحاب ذاكراً أراء المثبتين والمنكرين من الأثر والنظر عند المتقدمين والمتأخرين الذين اثبتوا أصالة الاستصحاب فمنهم من قدم عليه القياس ومنهم من قدمه على القياس ومنهم من أنكر القياس . فقسم الباحث البحث إلى ثلاثة مباحث تحدث في المبحث الأول عن الدليل وماهيته وأقسامه والأدلة المتفق عليها والمختلف فيها والمبحث الثاني عن دليل القياس ماهيته وبيان أراء العلماء حوله من مثبتين ونفاة مع ذكر الأدلة من الأثر النظر والمبحث الثالث الاستصحاب وبيان ماهيته وأقوال العلماء فيه وبيان ترتيب الأدلة ثم الخاتمة التي تحتوي والنتائج والتوصيات .

This is fundamentaljurisdiction at study in which the researcher tackles the fourth principles of the fundamental principles of Islamic jurisprudence there are different views regarding this fourth principle while some jurist consider it to be “ qixas” others. Consider it to be “ istishab” the researcher states both view . The researcher has clossipied his study into three chapter. The first chapter deals with the definition of the fourth principles it division and undisputed proofs relating there too. The second chapter deals with in which the researcher states the view of jurists including those in support of it being the fourth principle and those who disagree with this view with their respective proof The third chapter deals with ((istishab)) in which the researcher states the definition of the principles the jurists views in relative to it and their respective proofs and the conclusion which include the results and recommendation
