طـــرق الطعن في قــرارات التحكيم الإلكتروني

Abstract

مستخلص تناولت الدراسة موضوع : طرق الطعن في قرارات التحكيم الالكتروني: ويقصد بذلك مجموع القرارات التي تصدرها محاكم التحكيم الإلكترونية الفضائية بشأن الدعاوي المرفوعة امامها برضا أطراف النزاع ، بموجب شرط التحكيم الإلكتروني المرفق أو بمشارطة التحكيم الإلكتروني بناءً على الاتفاق المسبق عليه ، وقد تقضي تلكم المحاكم بقرارات قد لا يرضى بها الخصوم ، فقرارات محكمة التحكيم التقليدية يجوز الطعن فيها ، أما قرارات محكمة التحكيم الالكترونية فلا ، بحجة أنه بمجرد قبول الاطراف الاحتكام الى المحكمة الفضائية للتحكيم الالكتروني ، يعتبر ذلك عدولا" عن حقهم في الطعن.، وهنا تأتي مشكلة الدراسة، ولتحقيق هدف الدراسة تناولت المنهج الوصفي والتحليلي .، وقد اشتملت الدراسة على مقدمة وثلاثة فصول حللت فيها مشكلة الدراسة واهتدت مع بعضها لحلول لها ، فتناول الفصل الاول مفهوم التحكيم الالكتروني وقسمت الى اربعة مباحث ، وتناول الفصل الثاني اتفاق التحكيم الالكتروني وقسمت الى اربعة مباحث ايضا"، وتناول الفصل الثالث إجراءات التحكيم الالكتروني متضمنة طرق الطعن في قرارات محكمة التحكيم الالكترونية. ومن أهم نتائج الدراسة :هي، بالرغم من التشابه الكبير بين التحكيم التقليدي والتحكيم الالكتروني ،فإنه لا يجوز الطعن في قرارات محاكم التحكيم الالكترونية للأسباب السالفة الذكر ،وان الاستثناء الوحيد الذي يحق للأطراف بالطعن فيها هي في محكمة التحكيم الفضائية في ولاية ميشيغان (Michigan) الامريكية .، ومن اهم توصيات الدراسة هي ضرورة اعادة هيكلة اللوائح الداخلية لمؤسسات التحكيم الالكترونية بالدول التي تحجب حق الخصوم في الطعن ضد قراراتها التي لم يرضى بها الخصوم، وهو ما يتفق مع مبادئ المحاكمة العادلة والعقل الوجدان السليم . The study dealt with the topic: Methods of challenging electronic arbitration decisions: Thus, the total number of decisions rendered by space electronic arbitration tribunals in proceedings brought before them with the consent of the parties to the dispute, under the terms of the attached electronic arbitration clause or the electronic arbitration parties on the basis of prior agreement, and courts may be judged by decisions that may not be satisfied by the parties to the space court ,The study, to achieve the objective of the study on descriptive and analytical approaches, included an introduction and three chapters in which the study problem was solved and which were used to solve it, as the first chapter dealt with the concept of electronic arbitration and was divided into four investigations, and the second chapter dealt with the electronic arbitration agreement and divided into four investigations as well", chapter 3 deals with electronic arbitration procedures including the means of challenging arbitral awards. One of the most important results of the study is that, despite the great similarity between traditional arbitration and electronic arbitration, decisions of the electronic arbitration tribunals cannot be challenged for the reasons stated above, and the only exception in which the parties are entitled to challenge is in the US Court of Space Arbitration in Michigan State (Michigan). One of the most important recommendations of the study is the need to restructure the internal regulations of electronic arbitral institutions in States that deny parties the right to challenge decisions that are not satisfied by the adversaries, which is consistent with the principles of fair trial and sound conscience.
