Abstract

Abstract I have began this study, by a preliminary chapters, which I have divided to the shed light on the essence of direct, and indirect investments. I have dealt, in the first instance, with the impact of official and investment flows, an our Arab world, and the Sudan, in accordance with the official reports, issued by the international and regional institutions, relevant to the investment. Then, I dealt with the essence of invested funds, in accordance with what the legislations, multilateral and bilateral agreements have provided for, in the field of investment. There fore, of approaches the of role of investment, in promotion of economic development, in the Sudan. In chapter I, I shed light on the essence of Arbitration,(alternative dispute settlement) in the field of investment, its importance and the legal scope of international arbitration, on investment disputes, as to the safeguards of the concept of international'arbitration, on investment arbitration, and its types. I discussed, in chapter II, the procedural organization of arbitration, in the field of investment, starting by creation of arbitr?1 tribunal, up to passing the arbitration award, and specifying the applicable law. Chapter III considers the international organization of the issue of arbitration, in settlement of investment disputes, by reference, through and analysis, to the mandate of international and regional conventions .. in settlement of investment disputes, and the mandate of the standing arbitration centers, in settlement of such disputes. In chapter IV, we have highlighted the role of arbitration, in settlement of some private investment contracts disputes, such as petroleum contract, and international facilities and (Boot) and (Bol) contracts. We ended this chapter by setting out the role of arbitration, in setting the investment guarantee contracts, in accordance with the Multilateral international Guarantees Agreement, (MIGA) and the agreement of the a Arab Institutes for investment GUarantees. In the closing chapter of the research, I consequence the results of the study, and the recommendations .
