Part of Social Changes in the System of Marriage and Divorce in Nuer Society

Abstract

Abstract The study addressed some of the social changes in the system of marriage and divorce in the Nuer society, to find out the impact of changes on the social construction to this ethnic. The study aimed to knowledge the system and methods of marriage and divorce in the study society, and reveals the grounds and reasons for divorce and the negative impacts resulting from it, to identify the impact of social, cultural, political and economic changes on the system of marriage and divorce in Nuer society. And what are the social traits that have been caused by cash money paid as a bride-wealth and why the intellectuals Nuer preferred to married a rural girl, instead to marriage the civilized and educated one. The researcher has raised a number of questions concentrating on part of social changes that have occurred on the system of marriage and divorce in the Nuer society, and what extent the impact of migration and the expatriate acculturates, and what the instability cause by bride-wealth paid in money that substitute the main cow, and what possible on co-existing between modern and traditional system of marriage and divorce in the Nuer society life style? The researcher has used several methodologies such as descriptive, analytical, ‎Interviews, qualitative observations, focal group discussions, as well as primary and secondary data (literature ‎review) and other related aspects on social changes and transformations. The researcher also choose a simple random sample from the Nuer society living in Malakal city and distribute 120 forms of questionnaire, and only 100 forms returned, which formed a focal group discussion as well. Three theories such as structural functional theory, social exchange theory and bilateral pivotal theory for both traditional and modernist (Fashionable) society was used, The most important results emerged in this study, was a bride-wealth paid in term of cash money substituting the main wealth cow have caused a divorce and it became phenomenon and rampant at moment among the Nuer. However, in the past divorce was less, because the wealth was pay in a cow, make a man (husband) to have full responsibility over the wife and her kids as well as the whole house-affairs. Meanwhile others such as polygamy, jealousy, lack of the awareness of woman, lack of emotional satisfaction, aging, treason Marital, lack of the integrity and absence from home etc.. Contribute in divorce.. As well as the findings of the study it is clear that currently the dowry in the Nuer society is paid in both cows and in cash money, this means changes are occurring in the system of payment process of the dowry which was previously limited to cows only, also this shows a flexibility to facilitate and easy complete the marriage process as modern style for payment of dowry within the Nuer society in urban areas and overseas (Diaspora). The most result was that the dowry paid in cash contributed in increased occurrences of divorce percentage and instability of the family after the expiration of these funds, Whereas, the important results founded by researcher revealed that some of the trends of social changes affect the Nuer society are found and stationed in cash money pay as a bride-wealth to substitute cows, which previously played a key role, in addition to disintegration of family, acculturate cultures, immigration and particularly among those living in cities have contributed in the emergence of these changes. The researcher conducted several recommendations and the most important one is that Nuer society, should reduce payment of a cash money as a dowry, because the disposition of the money after the marriage, could lead to divorce and family instability, and It's necessary for immigrants Nuer to connect with their communities of origin to cope up with the changes that occur constantly, especially in the field of social, culture and legal, with regard to systems and cases of marriage and divorce in the Nuer society in general. In order to maintain the customs, traditions and social ties within the Nuer society, which they had inherited from their grandparents, it is necessary for the Nuer society to be compatible with modern systems to organize their social lives to cope the movement of the social change surrounding them. The researcher encourages intellectual educated Nuer to be proud of legitimate marriage and avoid to fall into the trap of illegal relationships during their school and university education, He “stated that marriage doesn't mean getting a child, but it’s a social contract that’s build through commitment, love and a good relationships that shall be blessed by God to get a child resembling both spouses and relatives kin”

مستخلص البحث تناولت الدراسة بعض التغيرات الاجتماعية في نظام الزواج والطلاق في مجتمع النوير، وأثر هذه التغيرات في البناء الاجتماعي لهذه الطائفة. وقد هدفت الدراسة إلى معرفة نظام وأساليب الزواج والطلاق في مجتمع الدراسة، ومحاولة الكشف عن أسباب ومسببات الطلاق، والآثار السلبية الناتجة عنه، والتعرف على أثر المتغيرات الاجتماعية والسياسية والاقتصادية والثقافية على نظام الزواج والطلاق في مجتمع النوير. وقد أثار الباحث عددا من الأسئلة تتركز على المتغيرات الاجتماعية التي طرأت على نظام الزواج والطلاق في مجتمع النوير، وما مدى أثر الهجرة والثقافات الوافدة عليه، ولمعرفة ما ينجم عن المهر المدفوع نقداً التي تحل محل المهر الرئيسي وهو البقر، وأيضا لمعرفة إمكانية العلاقة المشتركة بين الحداثة والنظام الاجتماعي التقليدي للزواج والطلاق في مجتمع النوير. استخدم الباحث المنهج الوصفي والتحليلي لوصف وتحليل البيانات الميدانية. قام الباحث باختيار عينة عشوائية بسيطة من مجتمع النوير في مدينة ملكال، والتي شكلت المجموعات البؤرية للمناقشة. استخدم الباحث عددا من النظريات مثل نظرية البناء الوظيفي ونظرية التبادل الاجتماعي، والنظرية المحورية الثنائية للمجتمع التقليدي والحداثي (عصرية) على حد سواء. وتوصلت الدراسة إلى عدة نتائج أهمها: أن ظاهرة الطلاق في مجتمع النوير متفشية في الوقت الراهن، أكثر من الماضي، تعني أن التغييرات الاجتماعية التي تنشأ داخل مجتمع النوير مثل دفع المهر نقدا بديلا عن البقر، تعدد الزوجات، والغيرة، وانعدام الوعي لدى المرأة، وعدم الارتياح العاطفي، والشيخوخة والخيانة الزوجية، وانعدام النزاهة والغياب عن المنزل والمعنويات الضعيفة للزوجة ... الخ، قد ساهمت في الطلاق، ولكن في الماضي كان الطلاق أقل ،لأن المهر المدفوع كان البقر التي تجعل الرجل لديه المسؤولية الكاملة على الزوجة وشؤون المنزل. كما كشفت الباحث أن بعض الاتجاهات في التغييرات الاجتماعية التي تؤثر على مجتمع النوير تمركزت في الأموال النقدية التي تدفع مهرا لاستبدال البقر، الذي لعب في السابق دورا رئيسيا في استقرار الحياة الزوجية ، ومن جهة أخرى التفكك الأسرة، والتأقلم مع الثقافات والهجرة وخاصة النوير الذين يعيشون في المدن قد ساهمت في ظهور هذه المتغيرات . أجرت الدراسة عدة توصيات أهمها: بالنسة لمجتمع النوير، يجب الحد من دفع مبالغ نقدية كمهر، لأن التصرف في المال بعد الزواج، يمكن أن يؤدي إلى الطلاق وعدم الاستقرار العائلي. فمن الضروري لمجتمع النوير ان يكون متوافقا مع النظم الحديثة لتنظيم حياتهم الاجتماعية لمواجهة حركة التغيير الاجتماعي المحيطة بهم.
