تناول البحث دور المحكمة الجنائية الدولية في حماية حقوق الإنسان، وتظهر أهمية الموضوع في أنها تتناول موضوعاً مرتبطاً بالقضاء الجنائي الدولي والعدالة الجنائية الدولية عبر التطور التاريخي والقضاء الجنائي المؤقت وصولاً إلى المحكمة الجنائية الدولية . تمثلت مشكلة البحث في الإجابة على في التساؤل التالي: ما مدى فعالية المحكمة الجنائية الدولية في حماية حقوق الإنسان وحرياته الأساسية؟، وانطلاقاً من هذا فقد هدف البحث إلى إبراز التطور التاريخي للقضاء الدولي الجنائي، بالإضافة لمحاولة التعرف على المشاكل والعقبات التي تحول دون تحقيق العدالة الدولية الجنائية. واتبع البحث المنهج الوصفي التحليلي لتحليل مضمون النصوص والإتفاقيات الدولية والمتضمنة آليات فعلية لحماية حقوق الإنسان، وكذا المنهج الإستقرائي للأحكام العامة لمشروع النظام الأساسي للمحكمة الجنائية الدولية كآلية مميزة وغير مسبوقة أدت إلى النظام القضائي الدولي. توصل البحث إلى عدد من النتائج والتوصيات ومن أهم النتائج: المحكمة الجنائية الدولية هي الآلية الوحيدة التي أنشئت من أجل تبلور الجهود الدولية المضنية، لإقرار نظام دولي جنائي عالمي يحظى بالقبول لدى الجماعة الدولية. أما أهم التوصيات: العمل على تفعيل قواعد القضاء الدولي الجنائي من أجل حماية حقوق الإنسان وحرياته الأساسية. توسيع اختصاص المحكمة الجنائية الدولية ليشمل جرائم الإرهاب والإتجار بالمخدرات، التي أخذت طابع الجرائم الدولية، وعلى المجتمع الدولي أن يضع تعريفاً مقبولاً لها.

Abstract

The research dealt with the role of the international criminal court in protearch human rights, and the importance of the topic appears in that it dealt with a topic related to temporary criminal justice up to the international Criminal Court. The research problem was represented in answering the following questions: what is the effectiveness of the international criminal court in protecting human rights and fundamental freedoms? Based on this the research aims to highlight the historical development of the international criminal judiciary. In addition to trying to identify the problems and obstacles that prevents the achievement of justice for the international criminal court. The research a number of conclusions and recommendations, among the most important results: the International Criminal Court is the only mechanism established in order for the strenuous international efforts to crystallize. To adopt a global international criminal order that is acceptable to the international community. As for the most important recommendations : work to activate the rules of the international criminal justice system in order to protect human rights and fundamental freedoms, also expanding the jurisdiction of the international criminal court to include crimes of terrorism and drug trafficking. The research followed the descriptive and analytical approach to analyze the content of international texts and agreements that contain actual mechanisms for the protection of human right. As well as the inductive approach to the general provisions of the draft statute of the in international criminal court as a distinct and unprecedented mechanism that led to the system in the international judicial system.
