أبعاد اللاجئين وفقاً لقواعد القانون الدولي

Abstract

مستخلص البحث تناول البحث موضوع إبعاد اللاجئين وفقاً لقواعد القانون الدولي، حيث تمثلت مشكلة البحث في أن قضية اللاجئين من أصعب القضايا التي تثار على المستوى الوطني والدولي في الوقت الراهن، وهذا نتيجة للعدد الهائل والمستمر بسبب كثرة النزاعات والمشاكل الاقتصادية للدول، وكذلك المشاكل العرقية والاضطهاد الديني والسياسي الذي دفع هؤلاء إلى هجرة أوطانهم والفرار إلى الدول المجاورة الأخرى على حياتهم والمطالبة بالأمن والاستقرار. واتبع الباحث المنهج الوصفي التاريخي لوصف ظاهرة الإبعاد وتأثيرها على المجتمعين المحلي والدولي منذ نشأتها وحتى الوقت الحاضر، إضافة إلى المنهج الاستنباطي لأنني أرتأيت استنطاق النصوص القانونية تمشياً مع موضوع الدراسة وفقاً للتشريعات الوطنية والقانون الدولي: وتوصل الباحث إلى عدة نتائج تتلخص أهمها في: • ضرورة تكاتف أعضاء المجتمع الدولي لمساعدة الدول المستقبلة للاجئين في تحمل أعبائهم وتفعيل مبدأ تقاسم الأعباء والمسؤولية تجاههم، فعلى الدول أن تدرك ضرورة معالجة مشكلة اللاجئين بصورة متكاملة بتمكينهم من ممارسة حقوقهم والسعي لإيجاد حلول دائمة لمشكلاتهم بالتعاون مع المفوضية السامية لشؤون اللاجئين وغيرها من المنظمات والوكالات ذات الصلة. • ضرورة التزام الدول المضيفة بتحمل مسؤوليتها وتمكين اللاجئين من الحصول على حقوقهم وممارسة حرياتهم التي كفلتها مواثيق حقوق الإنسان والاتفاقيات الخاصة باللاجئين، وأن تعمل على تثبيت حقوقهم لاسيما حقهم في عدم الإعادة القسرية (مبدأ عدم الرد). Abstract The research dealt with the issue of deporting refugees according to the rules of international law, where the research problem was that the refugee issue is one the most difficult issues raised at the national and international levels at the present time, and this is a result of the buge and continuous number due t the many conflicts and economic problem of countries, as well as ethnic problems and religious and political persecution what drove them to migrate their countries and flee to other neighboring countries for their lives and to demand security and stability, The researcher followed the historical descriptive approach to describe the phenomenon of deportation and its impact on the local and international societies from its inception to the present time, in addition to the deductive approach because I saw the questioning of legal texts in line with the subject of the study in accordance with national legislation and international law. The researcher reached several, the most important of which are: • The need for members of the international community to join hands to help countries receiving refugees bear their burdens and activate the principle of burden sharing and responsibility towards them. Countries should realize the need to address the refugee problem in an integrated manner by enabling them to exercise their rights and strive to find lasting relevant organizations and agencies. • The necessity of the commitment of the host countries to assume their responsibility and enable the refugees to obtain their rights and exercise their freedoms guaranteed by the human rights conventions and agreements for the refugees, and to work to establish their rights, especially their right to non – refoulement (the principle of non – refoulement).
