Abstract

المستخلص ناقشت الرسالة الصعوبات التي تواجه القاضي لتأدية عمله، منها تأخير القضايا وصعوبة تقدير الحق؛ فالقاضي بشر يصيبه التعب والانفعال والتحيز الإدراكي، ويتعرض لمغالطات منطقية في طرح المحاميين، فأخطاء القاضي تعطي انطباع بعدم العدالة وتضعف من هيبة القضاء، وتؤثر سلبا على المجتمع وعلى مستقبل القاضي المهني. تطرق البحث للتقنيات التي تساعد القاضي الجنائي من الناحية الإدارية والإجرائية والموضوعية، وركزت الدراسة على الجانب الموضوعي وقياس الحق كميا؛ وذلك للاستفادة من التقنية لمساعدة القاضي الجنائي، وللتوصل لطريقة يدركها الحاسوب ويتعامل معها القاضي بمصطلحات قانونية ظاهرة يقابلها خلفية رياضية داخل النظام، وقد قدر الباحث درجة الاطمئنان التي يبلغها القاضي لاتخاذ القرار بما هو أعلى من 66%، وذلك باستقراء الأصول الاصطلاحية في مصادر اللغة والمنطق والقانون، وتم اقتراح "ميزان الاستدلال" كأداة لحساب قيمة الأدلة بصيغة كمية، تمت الاستفادة من فكرة حساب الاحتمالات الرياضية، وتم تطبيق هذا النموذج على عدد من القضايا من مخرجات القضاء اليمني والسوداني، يساعد هذا النموذج في معايرة التقديرات، ومساعدة القاضي في التقدير وكذلك تقييم تقديرات القاضي من قضاة المحكمة أعلى درجة، ومن هذا يمكن تقييم أداءه المتراكم في التفتيش القضائي، وبهذا يساعد في تحقيق أكبر قدر ممكن من العدالة والشفافية والمصداقية، وإنجاز أكبر عدد ممكن من القضايا في وقت أسرع، كما أوصى الباحث نهاية الدراسة على عمل قاعدة معرفة متفق عليها بمعايرة كل أوزان الأدلة القانونية، وكذلك معايرة قيم الوقائع بالسوابق القضائية المقرة بالمحكمة العليا .

Abstract The thesis discussed the difficulties a judge faces in performing his work, including delaying cases and the difficulty of assessing the truth; Because the judge is a human being who could suffers from fatigue, affection and cognitive bias, and is subject to logical fallacies in the presentation of lawyers; The judge’s mistakes give the impression of injustice, weaken the prestige of the judiciary, and negatively affect society and the professional future of the judge. The research dealt with techniques that assist the criminal judge in administrative, procedural and substantive terms. The study focused on the objective aspect and measuring the right in value, in order to benefit from the technology to assist the criminal judge; To arrive at a way that the computer understands, and the judge deals with it in terms of apparent legal terms and mathematical background, the researcher estimated the degree of reassurance that the judge reached to make a decision that is higher than 66%, This is by extrapolating cognitive idiosyncratic principles from sources of language, logic and law, and establishing a "balance of thinking" as a tool for calculating the value of evidence in the form of value, The idea of ​​calculating mathematical possibilities was used, and this model was applied to a number of issues from the outcomes of the Yemeni and Sudanese courts. This form assists in calibrating case inputs, assisting the judge in estimating as well as assessing judge estimates from the highest-level court judges, From this it is possible to evaluate its accumulated performance in the judicial inspection, and thus help in achieving the largest possible degree of justice, transparency and credibility, and the completion of the largest possible number of cases in a faster time, The researcher also recommended the end of the study to work on an agreed upon knowledge base by calibrating all weights of legal evidence, Likewise, the calibration of judicial facts by case law selected by the Supreme Court.
