المركز القانوني للنيابة العامة (دراسة مقارنة )

Abstract

مستخلص البحث يهدف هذا البحث والذى جاء بعنوان المركز القانونى للنيابة العامة، لبيان وضع جهاز النيابة العامة بين أجهزة الدولة وسلطاتها وبيان مركزها القانونى، وقد إعتمد البحث على المنهج الوصفي التحليلي والمنهج المقارن والمنهج الإستقرائي، تناولت البحث فى الفصل الأول نشأة النيابة العامة، وفى الفصل الثاني هيكل النيابة العامة وإختصاصاتها، أما الفصل الثالث فخصصته للمركز القانونى للنيابة العامة، ثم ختمت الدراسة بخاتمة تتضمن أهم النتائج التى توصلت اليها ومنها أن النيابة العامة جهاز شبه قضائى، ومن أهم التوصيات ضرورة تعديل القوانين ذات الصلة لإيجاد ضمانات كافية لإستقلال النيابة العامة.

ABSTRACT This study which entitled "The legal status of public prosecution " aims at identifying the position of public prosecution body among the state agencies as well as its legal status. The study used analytical, comparative and inductive approaches and it was divided into three chapters. The first dealt with the emergence of public prosecution. The second chapter dealt with the strut fore and functions of public prosecutions. Chapter three introduced the legal statues of public prosecution. The study concluded with the most important finding such as the public prosecution is considerable a quasi-judicial organ. The study also recommended that the relevant laws should be amended to aerate sufficient gucerantees for the independence of public prosecution.
