مكافحة الإرهاب في ضوء ضمانات حقوق الأنسان

Abstract

المستخلص جاءت هذه الدراسة بعنوان: مكافحة الإرهاب في ضوء ضمانات حقوق الأنسان، وتعتبر ﻗﻀيتي حقوق الأنسان والإرهاب من أهم القضايا الوطنية والدولية التي نالت إهتماماً كبيراً في الوقت الراهن، حيث القي الضوء عليهما ﻭ تنوعت الدراسات بشأنهما علي اعتبار أن الإرهاب أصبح يشكل في السنوات الأخيرة تهديداً حقيقياً لأمن الجماعة الدولية والداخلية، وتحدياً دائماً لإستقرار الدول وإهدراً لكل حقوق الأنسان. وتمثلت مشكلة البحث في أن مسالة مكافحة الارهاب تتطلب في بعض الاحيان فرض قيود على بعض طوائف حقوق الإنسان. الامر الذي يثير التساؤل حول مدى تاثير ظاهرة الإرهاب علي ممارسة حقوق الانسان؟، وهل يوجد تعارض فعلي بين تدابير مجابهة الإرهاب وبين مقتضي ضمانات حقوق الانسان بشكل يرقي الي مخالفة المعايير الدولية التي تلزم حماية واحترام هذه الحقوق؟ ، ولتحقيق هدف الدراسة اتبع الباحث مناهج علمية متداخلة بين المنهج التاريخي والمنهج الوصفي مقروناً مع المنهج الأستنباطئ والمنهج الأستقرائي وذلك باستعراض الاراء الفقهية والأتفاقية حول الموضوع ومن ثم تحليلها واستنباط ماتشير اليه، وقد اشتملت الدراسة علي مقدمة وثلاثة فصول عالجت مع بعضها موضوع الدراسة، فتحدث الفصل الأول عن تحديدالإطار المفاهيمي لظاهرة الإرهاب، وفي الفصل الثاني تناول الباحث ضمانات حقوق الإنسان بين الإرهاب ومجابهته، بينما تطرق في الفصل الثالث الذي يمثل جوهر الدراسة إلي إستراتيجية مواجهة الإرهاب والحفاظ علي حقوق الإنسان. وتوصلت الدراسة إلي عدة نتائج أهمها: أن كثير من الدول لم تفلح في التوصل إلي نقطة التوازن بين حماية منظومة حقوق الإنسان من جهة وبين الدفاع عن أمنها وأمن مجتمعها منجهة ثانية. وأوصت الدراسة بعدد من التوصيات من أهمها ضبط عملية الإنتقاص من حقوق الإنسان في حالات الطوارئ وفي مجال الظروف الإستثنائية وفق مبدأ سيادة القانون وضمان معايير الشرعية القانونية وداخل إطار الشرعية الدستورية.

Abstract This study came under the title: anti- Terrorism in the Light of Human Rights Guarantees. The issues of human rights and terrorism are considered among the most important national and international issues that have received great attention at the present time, as light has been shed on them and studies have diversified on them considering that terrorism has become in recent years a real threat to the security of international and internal community and a constant challenge to the stability of states. The research problem was that the issue of combating terrorism sometimes requires imposing restrictions on some human rights sects. Which raises the question about the impact of the phenomenon of terrorism on the exercise of human rights? Is there an actual conflict between the measures to anti- terrorism and the requirement of human rights guarantees in a way that amounts to violating international standards that require the protection and respect of these rights? To achieve the aim of the study, the researcher followed scientific approaches intertwined between the historical and descriptive approaches coupled with the deductive and inductive approaches by extrapolating jurisprudential and agreement opinions on the subject and then analyzing them and deducing what they refer to. the study included an introduction and three chapters that dealt with each other the subject of the study. The first chapter talked about defining the conceptual framework of the phenomenon of terrorism. in the second chapter, the researcher dealt with human rights guarantees between terrorism and combating it, while the third chapter, which represents the essence of the study, discussed on the strategy of anti- terrorism and preserving human rights. The study reached several results, the most important of which is that Many countries have not succeeded in reaching a point of balance between protecting the human rights system on the one hand and defending its security and the security of its society on the other. the study recommended a number of recommendations, the most important of which were controlling the process of derogation from human rights in emergency situations and in the field of exceptional circumstances in accordance with the principle of the rule of law and ensuring standards of legal legitimacy and within the framework of constitutional legitimacy Ensuring standards of legal legitimacy within the framework of constitutional legitimacy.
