Abstract

‫مستخلص‪:‬‬ ‫السلطة‬ ‫مفهوم‬ ‫ِف‬ ‫البحث‬ ‫خًّلل‬ ‫من‬ ‫لإلدارة‬ ‫التقديرية‬ ‫السلطة‬ ‫ضوابط‬ ‫البحث‬ ‫تناول‬ ‫التقديرية‪.‬‬ ‫السلطة‬ ‫وأسلوب‬ ‫املقيدة‬ ‫السلطة‬ ‫وأسلوب‬ ‫لإلدارة‬ ‫التقديرية‬ ‫ماهية‬ ‫وبيان‬ ‫ة‬ ‫لإلدار‬ ‫التقديرية‬ ‫بالسلطة‬ ‫املتعلقة‬ ‫املفاهيم‬ ‫على‬ ‫التعرف‬ ‫إىل‬ ‫البحث‬ ‫هدف‬ ‫لإلدارة‪.‬‬ ‫التقديرية‬ ‫السلطة‬ ‫وجتاوزات‬ ‫انتهاكات‬ ‫من‬ ‫للحد‬ ‫هتدف‬ ‫اليت‬ ‫والوسائل‬ ‫اآلليات‬ ‫لإلدارة‪.‬‬ ‫التقديرية‬ ‫للسلطة‬ ‫دقيقة‬ ‫ضوابط‬ ‫وجود‬ ‫عدم‬ ‫ِف‬ ‫البحث‬ ‫مشكلة‬ ‫ومتثلت‬ ‫واملقارن‪.‬‬ ‫والتحليلي‬ ‫الوصفي‬ ‫املنهج‬ ‫البحث‬ ‫واعتمد‬ ‫ألداء‬ ‫معينة‬ ‫سلطات‬ ‫اإلدارة‬ ‫املشرع‬ ‫مينح‬ ‫أمهها‪:‬‬ ‫النتائج‬ ‫من‬ ‫العديد‬ ‫إىل‬ ‫البحث‬ ‫وخلص‬ ‫القانونية‪.‬‬ ‫اختصاصاهتا‬ ‫وممارسة‬ ‫وظيفتها‬ ‫إجياد‬ ‫على‬ ‫للعمل‬ ‫كافية‬ ‫لإلدارة‬ ‫التقديرية‬ ‫للسلطة‬ ‫ضوابط‬ ‫إجياد‬ ‫بضرورة‬ ‫البحث‬ ‫وأوصى‬ ‫مًّلءمة‪.‬‬ ‫إدارية‬ ‫وقرارات‬ ‫سلطات‬ ‫إصدار‬ ‫من‬ ‫متكنها‬ ‫نصوص‬ Abstract: The research dealt with the controls of the discretionary power of the administration by examining the concept of the discretionary power of the administration, the style of restricted authority, and the style of the discretionary authority. The aim of the research is to identify the concepts related to the discretionary power of the administration and to indicate what are the mechanisms and means that aim to reduce the violations and abuses of the discretionary power of the administration. The problem of the research was the lack of accurate controls for the discretion of the administration. The research adopted the descriptive, analytical and comparative method. The research concluded many results, the most important of which are: The legislator grants the administration certain powers to perform its function and exercise its legal powers. The research recommended the need to find enough controls for the discretion of the administration to work on finding texts that enable it to issue appropriate administrative powers and decisions.
