حماية الأعيان المدنية في القانون الدولي أثناء النزاعات المسلحة

Abstract

مستخلص تناول البحث حماية الأعيان المدنية أثناء النزاعات المسلحة في تطبيق القانون الدولي الإنساني وآليات تطبيقه. تمثلت أهمية البحث في دور الآليات في تطبيق قواعد القانون الدولي الإنساني سواء الدولية أو الوطنية المتعلقة بحماية الأعيان بجميع أنواعها أثناء النزاعات المسلحة. تكمن مشكلة البحث في التحدي الذي يواجه المجتمع الدولي تحت مظلة الأمم المتحدة لوضع الحلول المناسبة لمشكلة الانتهاكات التي تقع علي الأعيان المدنية أثناء النزاعات المسلحة وكيفية حمايتها علي نحو فعال في ظل ممارسات العديد من الدول دون الالتزام بالقواعد الأساسية للقانون الدولي الإنساني. هدف البحث إلي بيان أهمية الأعيان المدنية والمحافظة عليها من الانتهاكات التي تقع عليها بسبب النزاعات المسلحة والتي تخترق قواعده، وكذلك بيان أهمية العدالة الجنائية الدولية وارتباطها كجزء لا يتجزأ من العدالة الإقليمية الوطنية وبيان الآليات المناط بها تنفيذ قواعد القانون الدولي الإنساني لحماية الأعيان المدنية أثناء النزاعات المسلحة، وكذلك بيان الجرائم التي تنتهك الأعيان المدنية والثقافية والبيئية ووسائل الإعلام وجهود المجتمع الدولي لمحاربة تلك الانتهاكات. اتبع البحث المنهج الوصفي والمنهج التحليلي. توصل البحث لعدة نتائج وتوصيات، من أهم النتائج: إن القانون الدولي الإنساني ركز في معالجة مشكلة انتهاكات الأعيان المدنية أثناء النزاعات الدولية ولم يعطي النزاعات المسلحة الداخلية نصيب من نصوصه، الأمر الذي اظهر قصور واضح في مرحلة تطبيقه أثناء النزاعات المسلحة الداخلية، وإن المحاكم الجنائية الدولية كانت بمثابة لفت نظر لمعاقبة كل من يرتكب جرائم حرب وجرائم ضد الإنسانية. أهم التوصيات: تبني التشريعات واللوائح الوطنية من خلال إنشاء اللجان الوطنية، ونشر وتدريس أحكام اتفاقية لاهاي وبروتوكوليها الإضافيين.

Abstract The paper dealt with the protection of children during armed conflicts in light of the provisions of international humanitarian law, The paper aimed to clarify the protection provided by the Geneva Conventions to special groups, while clarifying the position of international humanitarian law on invoking military necessities to break the scope of responsibility when the special protection of these groups is violated, the problem of the paper was represented in studying the extent of the ability of the international legal framework to provide the necessary protection for special groups, the legal penalty imposed on violators of the provisions of international humanitarian law and those convicted of assault of whatever from on these special groups, and the extent of the effectiveness of international conventions, the paper followed the descriptive and analytical approach, and the paper was divided into two sections and four demands, the first topic dealt with the protection of children in armed conflict, and the second topic dealt with the prohibition of the participation of children in armed conflict, the paper concluded with a number of results, the most important of which are all the texts, rules and provisions related to the protection of some special groups during armed conflicts that remain on paper and do not go out of stalemate to a state of practical application, because these provisions and rules are hostage in the hand of the balance of political forces in the most important recommendations is that the international community should assume its responsibilities towards the violations that the special groups are exposed to by imposing international political, economic and diplomatic sanctions on those who violate the rules and provisions of international humanitarian law.
