دور لجان التحقيق الدولية في حماية و تعزيز حقوق الإنسان [دراسة مقارنة]

Abstract

مستخلص تناولت الدراسة دور لجان التحقيق الدولية في حماية وتعزيز حقوق الإنسان، تمثلت المشكلة في أن أدت الحروب والنزاعات الدولية والداخلية التي طرأت على المجتمع الدولي منذ الحرب العالمية الأولى والثانية وحتى نهاية القرن العشرين إلى تهديد السلم والأمن الدوليين، الأمر الذي أدى تشكيل لجان تحقيق دولية للتحقيق في انتهاكات حقوق الإنسان ورفع تقارير بشأنها، وتصادم تقارير هذه اللجان مع التقارير الدورية التي تقدمها الدول بموجب التزاماتها الدولية حيث تجد الدول نفسها مضطرة للانصياع إلى تقارير هذه اللجان، ولذلك تبرز عدة أسئلة منها: ماهي مبررات تشكيل لجان التحقيق الدولية وضوابط عملها؟ ما هو دور لجان التحقيق الدولية في حماية وتعزيز حقوق الإنسان؟ ما هو تأثير تقارير لجان التحقق الدولة على أوضاع حقوق الإنسان في داخل الدول؟ تتمثل أهمية الدراسة في إزالة الغموض حول كيفية إنشاء لجان التحقيق وأنواعها وطريقة عملها، دراسة وتحليل تقارير وتوصيات لجان التحقيق ومعرفة الضوابط التي تحكم عملها، إثراء وتزويد الباحثين بالمعلومات عن لجان التحقيق، حداثة الموضوع وعدم تناوله بالبحث. هدفت الدراسة إلى جمع المادة العلمية من نصوص القوانين وتقارير المفوضية السامية لحقوق الإنسان، ومقرري حقوق الإنسان، والخبراء المستقلين، ولجان التحقيق الدولية بقصد الوقوف على انتهاكات القانون الدولي لحقوق الإنسان، والقانون الإنساني الدولي لحمايتها، بحث الدور الذي تقوم به لجان التحقيق الدولية في حماية وتعزيز حقوق الإنسان. اتبعت الدراسة المنهج الوصفي التحليلي المقارن لدراسة وتتبع دور لجان التحقيق الدولية في حماية وتعزيز حقوق الإنسان، توصلت الدراسة إلى نتائج مهمة مثل أن مرحلة التحقيق تسهم في تحسين ضمانات حقوق المتهمين، هناك دور لتقارير وتوصيات لجان التحقيق الدولية في تشكيل المحاكم الجنائية الدولية، تنشأ لجان التحقيق الدولية على أساس قرارات الجمعية العامة للأمم المتحدة، وقرارات مجلس الأمن ومجلس حقوق الإنسان. بناء على ما توصلت إليه الدراسة من نتائج أوصلت الدراسة بضرورة الأخذ بتقارير وتوصيات لجان التحقيق الدولية، ضرورة إنشاء آليات إدارية للتعجيل بعملية التحقيق مع وضع لوائح داخلية تؤكد أهمية الضمانات القانونية للتحقيقات، يجب أن يتمتع أعضاء لجان التحقيق بالخلق الحميد ومشهود لهم بالاستقلال والحياد.

ABSTRACT The study discussed the role of international committees of inquiry in protection, and enhance human rights. The problem of the study repersentive that the international and national conflicts which had been emerged in international community , since the first and the second world wars , title the end of the twenty century to endanger to the peace and international security , which leads to form international inquiry committees to investigate on human rights voliotions , and lefting reports concerned with it , and the reports of this committees contradicting with international periodical reviews which conducted by states according to it's international responsibilities , so that the states it selfe to acceptance to the reports committees , therefore emerged many questions such as what the justifications to form international inquiry and it's disciplines of its work ? What the role of international inquiry committees in the protection and enhancing of human rights ?what the effects of the reports of international committees of inquiry to the situations of human rights into states ?. The necessity of study is to removed the ambiguity about how to establish committees of inquiry, it's types and means of its work, to study and analysing reports, recommendations of the committee of inquiry, and to know the measures which ruled its work , to enrich and supply the researchers with information of the committees of inquiry, because this subject is modern and does not discussed in the studies . The aim of study is to collect the scientific materials from the legal provisions, and reports of the high commission for human rights, arapporteurs of human rights, independent experts, and international committees of inquiry, to reached to violations of international law of human rights, and international humanitarian law to protect it, to study the role which could be conducted by international committees of inquiry in protection and enhance human rights. The study followed descriptive analysis comparative methodology to investigate and tracing role of international committees of inquiry in protection and enhance human rights . The study reached to important consequences such as the stage of inquiry contributing on improving the grantees of rights of the accused, there are role of reports and recommendations of international committees of inquiry in an information of international criminal courts, establishment of the international committees of inquiry basis on the resolutions of general assembly of the United nations, and resolutions of security council, human rights council, according to the results of the study which recommended it necessary to take the reports and recommendations of international committees of inquiry , Itis necessary to establish administrative mechanisms to accelerate the operation of inquiry with making internationalinternal legislations which emphasizes the important of legal grantees for inquiries, the members of inquiry must have a good behavior and witnesses with the neutrality and objectivity .
