Abstract

مستخلص الرسالة كتاب "العقـد النظيـم" في ترتـيـب قواعـد الأشـبـاه والنـظـائـر، للشـيــخ مـصطـفـى بن خيـر الـدين الرومي القاضي الحنـفـي، التركــي الأصــل, الشهيــر بِجَلَبٍ المتوفــى (1025ه). وهو كتاب فقهي تناول فيه مؤلفه رحمه الله تعالى القواعد الفقهية في كتاب الأشباه والنظائر لابن نجيم المصري الحنفي المتوفى (970ه)، حيث رتب هذه القواعد على منوال الكتب الفقهية، وشرحها وفصلها، ودخل في تفاصيلها، مما جعلها سهلة الفهم والمنال لِطالبها ومُبتغيها. وَتناولتُ هذا الكتاب دراسةً وتحقيقاً، في بحثٍ مقدم إلى جامعة النيلين كلية الدراسات العليا لنيل درجة الدكتوراه في الفقه الإسلامي، سائلاً الْمَوْلى عز وجل التوفيق والصواب، إنه وَلِيُّ ذلك والقادرُ عليه. فَبَدَأْتُ التحقيق في هذا الكتاب بعد التوكل على الله سبحانه وتعالى حيث كان هميّ الوحيد وبذلت قصارى جهدي أن أُخرجَ هذا الكتاب إلى أقرب ما أراده مؤلفه رحمه الله تعالى، وهذه هي غاية التحقيق، ومبتغاه. وعَمِلتُ في هذا البحث أن قسمته على مقدمة، وقسم للدراسة، وقسم للتحقيق، والخاتمة، والفهارس. أما المقدمة: فأوضح من خلالها، سبب اختيار الموضوع، وأهمية الكتاب، وحدود البحث، ومشكلة البحث، والدراسات السابقة للكتاب، ومنهج البحث، وهيكل البحث، وبيانات نسخ المخطوط. وأما القسم الأول: فهو قسم الدراسة، ويشتمل على فصلين: الفصل الأول: التعريف بالمؤلِفَّين وفيه مبحثان: المبحث الأول: التعريف بمؤلف كتاب الأشباه والنظائر، وفيه ستة مطالب: المطلب الأول: اسمه، ونسبته، ولقبه، وشهرته. المطلب الثاني: مولده، ونشأته. المطلب الثالث: شيوخه، وتلامذته. المطلب الرابع: ثناء العلماء عليه. المطلب الخامس: آثاره العلمية ومناصبه التي تقلدها. المطلب السادس: وفاته. المبحث الثاني: التعريف بمؤلف كتاب العقد النظيم، وفيه ستة مطالب: المطلب الأول: اسمه، ونسبته، ولقبه، وشهرته. المطلب الثاني: مولده، ونشأته. المطلب الثالث: طلبه للعلم، ومشايخه، وتلاميذه. المطلب الرابع: مكانته العلمية، وثناء العلماء عليه. المطلب الخامس: آثاره العلمية ومناصبه التي تقلدها. المطلب السادس: وفاته. الفصل الثاني: التعريف بالكتابين، الأشباه والنظائر، والعقد النظيم، وفيه مبحثان: المبحث الأول: التعريف بكتاب الأشباه والنظائر، وفيه ثلاثة مطالب: المطلب الأول: التعريف بالكتاب. المطلب الثاني: أهمية الكتاب. المطلب الثالث: عناية العلماء بالكتاب. المبحث الثاني: التعريف بكتاب العقد النظيم، وفيه خمسة مطالب: المطلب الأول: اسم الكتاب. المطلب الثاني: نسبة الكتاب إلى مؤلفه. المطلب الثالث: منهج المؤلف في الكتاب. المطلب الرابع: موارد الكتاب ومصادره. المطلب الخامس: موضوع الكتاب ومضامينه ونظام ترتيبه. وأما القسم الثاني: قسم التحقيق وفيه: مقدمة المؤلف رحمه الله تعالى. والنص المحقق، من (كتاب الطهارة إلى كتاب الوصايا وهو آخر المخطوط ختم به المؤلف رحمه الله تعالى)، وفيه الخاتمة، وأهم نتائج البحث التي توصلت إليها من خلال تحقيقي، كتاب "العقد النظيم" في ترتيب قواعد الأشباه والنظائر وقِمتُ أيضاً بعمل مجموعة من الفهارس العامة، ليسهل للقارىء، الوصول إلى غايته، وكذلك فهرس الموضوعات.

Thesis abstract The book "The Contract of Nazim" in the order of the rules of analogues and isotopes, by Sheikh Mustafa bin Khair al-Rumi Judge Hanafi, the Turkish origin, famous for bringing the deceased (1025 e). It is a book of jurisprudence in which the author, may Allah have mercy on him, addressed the rules of jurisprudence in the Book of Ashaba and Nazarenes of the son of Najim, the Egyptian Hanafi, who died (970 AH), where he arranged these rules in the style of jurisprudential books and explained them and separated them and made them easy to understand. This book dealt with the study and investigation, in a research presented to the University of Al-Nilain College of Graduate Studies to obtain a doctorate degree in Islamic jurisprudence, asking the Almighty to reconcile and right, he is the guardian of that and capable of it. I began to investigate this book after trusting God Almighty, where was my only one and did my best to bring this book to the nearest desired by the author, may God have mercy on him, and this is the goal of the investigation, and Mptgah. In this research, I divided it into an introduction, a study section, a section for investigation, a conclusion, and indexes. The introduction is explained by the reason for choosing the topic, the importance of the book, the limits of the research, the problem of research, the previous studies of the book, the research methodology, the structure of the research, and the copy of the manuscript. The first section is the section of the study. It consists of two chapters: Chapter 1: Definition of the authors, in which there are two sections: The first topic: Introducing the author of the Book of Asbahs and isotopes, in which there are six demands: the first requirement: his name, his relation, his surname, and his fame. Second requirement: birth, and origin. Third: His elders and his students. The fourth requirement: praise of scholars. The fifth requirement: its scientific effects and its position. The sixth requirement: His death. The second topic: the definition of the author of the book of the contract Alnzim, and in which six demands: the first demand: his name, proportion, surname, and fame. Second requirement: birth, and origin. Third requirement: His request for knowledge, and his disciples, and his disciples. The fourth requirement: His scientific status, and the praise of the scholars. The fifth requirement: its scientific effects and its position. The sixth requirement: His death. Chapter Two: The definition of the two books, analogues and isotopes, and the organizing contract, in which two sections: The first topic: the definition of the book of the ashes and isotopes, in which there are three demands: the first requirement: the definition of the book. The second requirement: the importance of the book. The third requirement: the care of scholars of the book.
