الاحكام الفقهية في رفع الاضرار المعنوية : دراسة مقارنة

Abstract

مستخلص البحث الحمد لله رب العالمين والصلاة والسلام على سيدنا محمد وعلى آله الطيبين الطاهرين وعلى صحبه الكرام أجمعين ... أما بعد : فهذا البحث يحتوي على الأحكام الفقهية في رفع الأضرار المعنوية عن الزوجة ، دراسة فقهية مقارنة ، وقسم الباحث الرسالة إلى تمهيد وأربعة فصول ، فذكر في التمهيد : مفهوم الأضرار المعنوية . أما الفصل الأول : فذكر فيه مفهوم الطلاق ، ودليل مشروعيته ، وحكمه ، وأقسامه ، والحكمة منه ، وأثره في رفع الضرر عن الزوجة . والفصل الثاني : فذكر فيه مفهوم الظهار ، وحكمه ، وما يتعلق بصيغته ، ومفهوم كفارة الظهار ، وأنواعها ، ورفع الضرر عن الزوجة المظاهر منها. أما الفصل الثالث : فذكر فيه مفهوم الايلاء ، ودليل مشروعيته ، وطبيعته ، وحكمه ، ومدته الشرعية ، موقف الشريعة من المولي وفيئه ، نوع طلاق المولي ، وموقف القاضي من التفريق بينهما ، وعدة الزوجة المولي منها ، وأثر التأقيت للإيلاء في رفع الضرر عن الزوجة . أما الفصل الرابع : فذكر فيه مفهوم الغيبة، وأقوال الفقهاء في مدتها ، التفريق بسبب الغيبة والحبس ، هجر الزوج فراش زوجته رغبة في المضارة ، ايذاء الزوج لزوجته دون نشوز منها . ثم ختم الرسالة بأهم النتائج التي توصل إليها ، وكذلك التوصيات .
