التنظيم القانوني لمياه حوض النيل (دراسة تحليلية)

Abstract

مستخلص تناولت الدراسة قضية المياه الأكثر أهمية من قضية النفط في العالم لذلك إتجهت الصراعات علي المياه والتي تعتبر محور الحروب القادمة نظراً لتزايد سكان العالم الي جانب ذلك عدم وجوداتفاقية شاملة تنظم استخدام واستغلال مياه النيل بين دول حوض النيل. تهدف هذه الدراسة لبحث جوانب التعاون بين دول حوض النيل بهدف تعظيم الإستفادة من موارد الأنهار وبحث أسباب الخلاف بين الدول خاصة في ظل وجود إختلاف حول الإتفاقيات المنظمة للمياه وعدم وجود تعاون بين دول حوض النيل . قسمت الدراسة إلى ثلاثة فصول تناولت التنظيم القانوني لمياه حوض النيل ومشكلة حوض النيل والإطار التنظيمي للتعاون بين دول حوض النيل وفقاً لأحكام القانون الدولي. اتبعت الدراسة المنهج التاريخي والمنهج الإستقرائي الوصفي التحليلي المقارن الذي يعتمد علي وصف ظاهرة مشكلة حوض النيل وأثرها علي التنمية وفقاً للنصوص والإتفاقيات الدولية. توصل الباحث إلي مجموعة من النتائج أهمها أن الإهتمام بالمياه إزداد في الأوانِ الأخيرة بشكل كبير ولابد من تعاون الشعوب بحسن نية عبر سن تشريعات وإتفاقيات فاعلة تنظم إستخدام مياه حوض النيل وجاءت أهم التوصيات بضرورة إيجاد إتفاقية شاملة تضم كل الدول المشاطئة لنهر النيل لتنظيم إستقلال مياه النيل لمعالجة مشكلة مياه حوض النيل.

Abstract The issue of water is more important than the issue of oil in the world. Therefore, water conflicts are the focus of the coming wars due to the increasing population of the world. Therefore, this study comes to discuss aspects of cooperation between the Nile Basin countries with a view to maximizing the utilization of river resources. Differences over the agreements governing the water and the lack of cooperation between the Nile Basin countries. The study was divided into three chapters dealing with the legal organization of the Nile Basin water and the Nile basin crisis and the regulatory framework for cooperation between the Nile basin countries to get out of the crisis according to the provisions of international law by following the historical method and the descriptive method of comparative analytical descriptive which depends on describing the phenomenon of the Nile basin crisis and its impact on development according to the texts and agreements International. The researcher reached a number of results, the most important of which is that the importance of water has increased in the last time and it is necessary to cooperate with the peoples in good faith through the enactment of effective legislation and agreements governing the use of water in the Nile basin.
