القواعِد الأُصوليّة المُتعلِّقة بِالإجماع والقياس والأدلة التّبِعيّة ونماذِج مِن تخريجاتِها الفِقهيّة في كِتاب نِهايَة المُحتاج إلى شرح المِنهاج لِلإمام الرّمليّ "دراسة وتحليل"

Abstract

المستخلص تناولت الدراسة القواعِد الأُصوليّة المُتعلِّقة بِالإجماع والقياس والأدلة التّبِعيّة ونماذِج مِن تخريجاتِها الفِقهيّة في كِتاب نِهايَة المُحتاج إلى شرح المِنهاج لِلإمام الرّمليّ، حيث هدفت إلى التعرف على القواعد الفقهية والأصولية المتعلقة بالإجماع والقياس في كتاب نهاية المحتاج إلى شرح المنهاج للإمام الرملي، وتوضيحها. وتأتي أهمية البحث من أن النصوص التشريعية وإن كانت متناهية لتناهي النصوص وعدم تناهي الأحداث لكن الشريعة الإسلامية بكلياتها العامة المنصوص عليها في الكتاب والسنة وقواعدها الأصولية المنقولة عن الأئمة المجتهدين بمنطوقها ومفهومها قد اشتملت على جميع الأحداث والمستجدات تخريجاً وتفريعاً، وأن للشرع أساساً بديعاً هو منشأ كل تفصيل وتفريع، وأن المسائل الفرعية على اتساعها وبعد غاياتها لها أصول معلومة وأوضاع منظومة وأن الفروع إنما تبنى على الأصول فعليه يجب أن يعلم الإنسان الفروع للوصول إلى الأصول. واتبعت الدراسة المنهج الاستقرائي التحليلي وكذلك الوصفي ومن خلال ذلك فقد عمد الباحث إلى عزو الآيات إلى سورها وتخريج الأحاديث الواردة فيه والترجمة للأعلام الذين تناولهم في البحث، كما قام بالتوثيق للمصادر والمراجع. وقد خرج البحث بنتائج من أهمها: إن النصوص التشريعية وإن كانت متناهية لتناهي النصوص وعدم تناهي الأحداث، لكن الشريعة الإسلامية بكلياتها العامة المنصوص عليها في الكتاب والسنة وقواعدها الأصولية المنقولة عن الأئمة المجتهدين بمنطوقها ومفهومها قد اشتملت على جميع الأحداث والمستجدات اللامتناهية تخريجاً وتفريعاً. وإن المسائل الفرعية على اتساعها وبعد غاياتها لها أصول معلومة وأوضاع منظومة وأن الفروع إنما تبنى على الأصول. وأيضاً من أهم التوصيات التي توصلت لها الدراسة أوصلت بضرورة الاهتمام بالقواعد الأصولية وذلك لما لها من أهمية كبيرة في حياة الإنسان، ولكي تعينه على فهم أمورهم الدينية والدنيوية، وأنه يجب على الدارسين من بعدي الوقوف على أمر القواعد الأصولية وتناولها بصورة شاملة. Abstract This study dealt with the fundamental percepts that related with unanimity and measure and models of its jurist extractions in the book of (Nihayt Al-MuhtagIllaSharah Al-Minhag of Al- Imam Al- Ramli). The research aimed to identify the jurist percepts and rules that related with the unanimity and measure in the book (Nihayt Al-MuhtagIllaSharah Al-Minhag of Al- Imam Al- Ramli).The importance of the study That the legislative texts, although finite to the end of texts and non-end events, but Islamic law in its public colleges stipulated in the Koran and Sunnah and fundamentalist rules transferred from the imams diligent in its nature and concept has included all events and developments in detail and excellence, and that the Sharia is an excellent basis is the origin of every detail and division, Sub-matters on the breadth and after the ends have known assets and conditions of the system and that the branches are based on the assets must know the human branches to access the assets. The study followed the analytical method as well as the descriptive and through that the researcher has to attribute the verses to the wall and the graduation of the conversations contained in it and the translation of the media who took them in the research, and documented the sources and references. The results of the research are the most important: The legislative texts, even if they are finite for the finalization of the texts and the non-recurrence of events, but Islamic law in its public colleges provided for in the Quran and Sunnah and its fundamentalist rules transmitted by the imams who are diligent in its meaning and concept included all the endless events and developments. Sub-issues on the breadth and after their ends have known origins and conditions of the system and that the branches are based on the assets. Also, one of the most important recommendations of the study is that it is necessary to pay attention to fundamentalist rules because it is of great importance to human life and to help him understand their religious and worldly matters and that scholars should follow the rules of fundamentalism and deal with them comprehensively.
