الحماية القانونية للنماذج الصناعية ( دراسة مقارنه)

Abstract

This study dealt with the legal protection of industrial models in national law and international conventions. Industrial models are of great importance in giving goods and products the distinctive and attractive appearance of the consumer public and protecting producers from attacks on their products. The importance of the study was that the industrial model gives the goods and products the distinctive and attractive appearance of the consumer audience and the protection of producers from the abuse of their products that had to address the international legal protection and internal laws. The study aimed to clarify the general concept of industrial models as one of the industrial property departments and clarifying the formal and objective conditions required to register the industrial model in order to enjoy legal protection. The problem of the study was the extent of the effectiveness of the legal protection of industrial models in Sudanese law compared to the international conventions related to the study, through the follow-up of court rulings and case law and the availability of means of protection in practice and theoretically. This study followed the descriptive method, where the researcher followed the subject of study in Sudanese law compared to the relevant international conventions. The study reached several results, the most important of which is that the industrial designs are the appearance of the product that earns an attractive aesthetic character, industrial models working to raise the commercial value of the product and facilitate marketing, and based on the results reached the most important recommendations are that the industrial models are attractive to even overshadow the product quality and excellence.
