أصُولُ الفِقْه ِعِنْدَ الإمام أبي داود السجستاني من خلال سننه دراسة تطبيقية على مصادر التشريع

Abstract

ملخص الرسالة الحمد لله والصلاة والسلام على رسول الله وآله وصحبه ومن والاه، وبعد: الرسالة مقدمة لنيل درجة الماجستير في أصول الفقه. عنوان الرسالة: أصول الفقه عند الإمام أبي داود السجستاني من خلال سننه دراسة تطبيقية على مصادر التشريع اسم الباحث: رعد محسن حاوي السامرائي. تم في هذه الرسالة دراسة بعض مباحث أصول الفقه لإمام من أئمة الحديث المتقدمين في كتابه السُنن، وفي ذلك إظهار لجهود فقهاء المحدثين في علم أصول الفقه مما يدعم الدراسات التاريخية في ذلك العلم. وقد جاءت الرسالة في مقدمة وفصل تمهيدي وفصلين وخاتمة: المقدمة: جاء فيها بيان اهمية الموضوع وأسباب اختياره. الفصل التمهيدي الأول: جاء فيه التعريف بما تضمنه عنوان الرسالة من التعريف بعلم أصول الفقه وبيان حياة الإمام أبي داود الشخصية والعلمية، وبيان منزلة كتابه السنن. الفصل الثاني: مصادر التشريع الأصلية، الكتاب والسنة. الفصل الثالث: مصادر التشريع التبعية المتفق عليها (الإجماع والقياس)، والمختلف فيها (شرع من قبلنا وقول الصحابي). أهم النتائج: 1_ العلاقة القوية بين أصول الفقه والنصوص الشرعية. 2_ أن أبا داود كان له علم راسخ ومشاركة في علم أصول الفقه. 3_ موافقة أبو داود رأي الجمهور. أهم التوصيات: 1_ العناية بكتب الحديث، واستخراج المسائل الأصولية منها. 2_ دراسة الجانب الفقهي عند أبي داود. Conclusion Praise be to Allah and peace and blessings be upon the Messenger of Allah and his family and companions, and after: This Thesis presented to obtain a Master's Degree in Fundamentals of Fiqh (Jurisprudence). Thesis title: Fundamentals of Fiqh (Jurisprudence) of Imam Abu Dawood Al-Sijistani through his book (Sunan Abu Dawood) an applied study on the sources of legislation. Researcher name: Raad Mohsen Hawi Al-Samarraie In this thesis, I have conducted a study in some topics of the fundamentals of Fiqh (Jurisprudence) of Imam Abu Dawood book (Sunan of Abu Dawood), in such study, this would acknowledge the efforts of other scholars in the fundamentals of Fiqh which supports the historical studies in this science. This Thesis is consisting of introduction, introductory chapter, two chapters and the conclusion : Introduction: Stating the importance of the topic and the reasons for choosing it. The introductory chapter: the definition of the Thesis with introducing the fundamentals of Fiqh (Jurisprudence) along with description of Imam Abu Dawood personal and scientific life and describing the importance of his book. Chapter II: original legislation sources, the Quran and Sunnah of the Prophet. Chapter III: sources of dependency legislation agreed upon (unanimity, quotation), and the contradicting sources (such as initiated by us and sahabah saying). The important results: _ The strong relationship between the jurisprudence and legal texts. _ Abu Dawood has great knowledge and participation in the fundamentals of Fiqh (Jurisprudence). _ Approval of Abu Dawood with public opinion. The important recommendations: _ Taking care of the Hadith books, benefiting of the fundamental issues therefrom. _ Studying the Fiqh ideology of Abu Dawood.
