دور الاتحاد الأفريقي في حماية حقوق الإنسان

Abstract

مستخلص الدراسة تناولت هذه الدراسة دور الاتحاد الإفريقي في حماية حقوق الإنسان، ووضحت الدراسة الحقوق التي كفلتها المواثيق الإفريقية والآليات التي تقوم بحماية تلك الحقوق ودورها في حماية تلك الحقوق. الدراسة مقسمة إلى ثلاثة فصول، الفصل الأول: مفهوم حقوق الإنسان في اللغة العربية والقانون الدولي ونشأة الاتحاد الأفريقي وأهدافه ومبادئه، الفصل الثاني: يحتوي على مصادر حقوق الإنسان في أفريقيا وهي عبارة عن الميثاق الأفريقي للإنسان والشعوب والاتفاقيات الأخرى المتعلقة بحقوق الإنسان، الفصل الثالث: تناول آليات حماية حقوق الإنسان في أفريقيا وهما اللجنة الأفريقية والمحكمة الأفريقية للإنسان والشعوب وتناول أيضاً نماذج لبعض القضايا في القارة ودور الاتحاد الأفريقي في حلها. هدفت الدراسة إلى إبراز دور الاتحاد الأفريقي في حماية حقوق الإنسان الأفريقي وما هي الآليات التي يمكن أن يلجأ لها الاتحاد في حالة انتهاك دولة عضو لحقوق الإنسان. قد توصل الباحث إلى نتائج عدة منها أن للاتحاد الإفريقي أهداف ومبادئ عظيمة تتبنى حماية حقوق الإنسان الأفريقي ولكن هنالك معوقات حالت دون تحقيق تلك الأهداف والمبادئ (الحروبات الأهلية ونزاعات الحدود وعدم المقدرة المالية). بعد إطلاع الباحثة على الميثاق الأفريقي للإنسان والشعوب وعلى الآليات التي تعنى بحماية الميثاق الأفريقي للإنسان والشعوب توصي الباحثة بإزالة العوائق التي وقفت أمام تلك الآليات ومنعتها من تحقيق أهدافها.

ABSTRACT This study addressed the role of the African Union in protecting human rights, and clarified the rights guaranteed by African charters and mechanisms that protect those rights and their role in protecting those rights. The study is divided into three chapters, Chapter 1: The concept of human rights in the Arabic language and international law and the emergence of the African Union and its objectives and principles, Chapter II: Contains the sources of human rights in Africa, which is the African Charter of man, peoples and other conventions related to Human Rights, Chapter 3: Addressing the mechanisms for the protection of human rights in Africa, namely the African Commission and the African Court of Human and Peoples, and also addressed examples of some issues on the continent and the role of the African Union in resolving them. The study aimed to highlight the role of the African Union in protecting African human rights and what mechanisms the Union can use in the event of a member state's violation of human rights. The researcher has reached several conclusions, including that the African Union has great goals and principles that embrace the protection of African human rights, but there are obstacles to achieving those goals and principles (civil wars, border disputes and financial inability). After informing the researcher about the African Charter for man and peoples and the mechanisms that protect the African Charter for human beings and peoples, the researcher recommends removing the obstacles that stood in the way of those mechanisms and preventing them from achieving.
