جريمة تقويض النظام الدستوري في التشريعات السودانية

Abstract

مستخلص البحث يتناول هذا البحث الذي يحمل عنوان جريمة تقويض النظام الدستوري في التشريعات السودانية الكيفية التي نظمت بها التشريعات السودانية هذه الجريمة، متتبعاً التدرج التاريخي لتشريعها وارتكابها والآثار القانونية وغير القانونية التي تترتب عليها، إنتهاءاً بالممارسة القضائية في محاكمة الجناة. يعقد البحث مقارنة بين جريمة تقويض النظام الدستوري وجريمة البغي في الفقه الإسلامي من حيث الأركان والشروط والعقوبة. يأخذ البحث بالمنهج الوصفي التحليلي التاريخي المقارن، دون إغفال القوانين التي نظمت الجريمة واتجاهات القضاء، بمعيار ثابت أن تقويض النظام الدستوري يظل جريمة ولو رتب آثاراً رفعت المسؤولية الجنائية عن مرتكبيها. Abstract This dissertation , which is entailed the crime of the undertaking of the , constitutional system in Sudanese legislations , addresses the manner in which Sudanese legislations identified this crime . it traced its historical pattern , perpetration , it is legal and non legal aftermath , and the judicial execution of perpetrators. This dissertation compares the crime of wrecking the constitutional system and the crime of infringement in Islamic jurisprudence with respect to bases, condition and penalty. The dissertation follows the comparative , historical , analytical and descriptive approach , without ignoring the rules which identified the crime and the judicial approaches according a constant measure. The undertaking of the constitutional system is considered of criminal responsibility.
