في هذا البحث عمل الباحث على بيان حقيقة كل ما يخصموضوع الأمر من تعاريف لغة واصطلاحا، ويبرز للقارئ أهمية باب الأمر في أصول الفقه من بين الأبواب الأخرى وكثرة معانيه في قواميس اللغة دالة على عظيم قدره وهذه المعاني اللغوية مترادفة مع المعاني الشرعية للأمر وأن هناك صيغ صريحة وصيغ غير صريحة أوصلها بعض العلماءإلى ثلاثين معنى وأن منها ما هو حقيقة في الأمر مجاز في غيره، ويوضح هذا البحث موقف العلماء من الأمر وانقسامهم فيه إلىالوجوب،الندب،الاباحة، التوقف. وفي البحث تطبيقات للقاعدة في باب العبادات اتخذ من الحج والزكاة انموذجاً، واتى تطبيق القاعدة في باب المعاملات في مسألتيالدين، والاشهاد على الدين. ثم كان مسك ختم بخمس مسائل تتعلقبتطبيقات القاعدة وهي: حكم النكاح لمستطيعه، استئذان البكر البالغة، متعة الطلاق، حكم الأكل من الأضحية، والإسراع في الجنازة. The dissertation contain all about the subject. Definitions linguistic and terminological meaning. In addition, it show for the reader the important of this chapter (the command) between other chapters in Fundamentals of Fiqh. And the increases of its meaning in dictionaries of language prove the momentous of its. These linguistic meanings synonymous with the Terminological meanings. There are explicit formats and non-explicit formats. Some scientists compute it to thirty meanings. In addition, There is some true meanings in (the command) and a figuratively in others. This dissertation shows the attitude of scientists from (the command) and they were divided into four opinions: the obligatoryopinion, the recommendableopinion, the Permissibilityopinion, and the stood upopinion. Thus, the research came to the applications of al-Qaeda in the chapter of worship Zakat and Hajj as a model, and the application came as the basis of transactions in debtand Certification of debt as an example. Finally five various issues were Included belonging to applications rulewhich are:judgment of marriage for who can Marrying,Adult virgin permission, Alimony,judgment of eating from sacrifice and Speeding on the funeral.
