الحماية القانونية للعقود امتياز البترول والمصادر البديلة للطاقة (دراسة مقارنة)

Abstract

مستخلص البحث يعتبر النفط من أهم التحولات الطبيعية التي تكمن في مناطق تجمعها في باطن الطبقات السفلي في سطح الأرض وقاع البحار والمحيطات، ولقد خصت الطبيعة بعض مناطق العالم دون غيرها باحتواء أرضها واحتضان جوفها لتلك الثروات النفطية الثمينة، وقد تميزت الصناعة النفطية منذ بدايتها بصفتها الدولية، ومما لا شك فيه أن الاستثمارات الأجنبية وانتقال رؤوس الأموال الخاصة في مجال الاستثمارات النفطية الأجنبية وفي المجال الدولي يحقق مصلحة خاصة لاصحابه وللدول الوافد إليها على حد سواء، وبقدر ما تكون هناك مصالح في الحركة الدولية لانتقال رؤوس الأموال الخاصة تكون هناك حاجة قانونية لتنظيم هذه الحركة وتشجيعها خدمة للمصالح المذكورة ، كما أن تشجيع رؤوس الأموال الخاصة على الاستثمارات النفطية الأجنبية في الدول النامية والأقل تقدماً هو فضلاً عن مزاياه الاقتصادية لأصحاب رؤوس الأموال وفوائده الاقتصادية للدول المصدرة لرأس المال يعتبره خطوة هامة للأسهام في تنمية الدول الفقيرة خاصة مع قصور مواردها الداخلية وعدم كفاية المعونات والقروض التي تتلقاها من الحكومات الأجنبية والمنظمات الدولية، ولقد تعرضنا للعديد من الموضوعات المتعلقة بتعريف للبترول في السودان، عالمياً واقليمياً، كذلك طبيعته واكتشافه في السودان، ونشأة الاتحاد الاحتكاري للبترول العالمي، وفقاً لمعاييرها التجارية، وقد حققت الشركات الأجنبية ، ثم عرضنا الحماية القانونية لاستثمارات الأجنبية النفطية، وبينت هذه الدراسة الحماية الموضوعية للاستثمارات الأجنبية الخاصة في الاتفاقيات الثنائية، كما بينت هذا البحث المصادر البديلة للطاقة وطرق حمايتها، كما وقفت البحث علي عقود امتياز البترول نشأتها وتطورها والتعديلات التي أدخلت على عقود الامتياز الأولي، ث عقود البترول في قارة الأفريقيا والسودان، ، كذلك عرضنا مستقبل العلاقة النفطية بين المنتجين والمستهلكين وعلاقة منظمة الأوبك بوكالة الطاقة الدولية والدول النامية المستهلكه للنفط ودور الشركات النفطية الكبرى في مجال الصناعة النفطية، كما بينت الدراسة الضمانات القانونية للعقود النفطية، كما وقفت هذه الدراسة على التحكيم في عقود البترولية و كيفية حل كافة منازعات عقود الامتياز البترولية. Abstract Oil is one of the most important natural resources that lie in the regions of the lower layers of the earth, the seabed and the oceans. Nature has allocated some areas of the world to contain its land and embrace its precious oil resources internationally. There is no doubt that the foreign investments and the transfer of private capital in the field of foreign oil investments and in the international field is of particular interest to both owners and countries to which it is a member. As far as there are interests in the international movement of private capital, The promotion of private capital on foreign oil investments in developing and less developed countries, as well as the economic advantages of capitalists and the economic benefits of capital-exporting countries, is considered an important step in the contribution of Development of poor countries economy, especially with the lack of internal resources and insufficient aid and loans received from foreign governments and international organizations, In this research, we discussed several issues related to definition petroleum and historical development of oil or petroleum in Sudan, both regionally and globally, as well as its nature and its discovery in Sudan and civil responsibility of environmental pollution of petroleum, Aswell as we discussed alternative sources of energy and ways of protecting them by presenting the basic features of natural gas in terms of characteristics, production, consumption and trade in the new millennium. Coal, hydroelectric, renewable, nuclear and geothermal energy were presented as modern models of investment development in the field Industry, aslo we presented the oil concession contracts, their development, the amendments to the initial concession contracts, and the oil contracts in Sudan and Africa as whole, We presented the future of the oil relationship between producers and consumers, we have presented also the definition of arbitration in petroleum contracts and its development, in all disputes of petroleum concession contracts.
