طرق اختيار رئيس الدولة في النظم السياسية المعاصرة بالتركيز علي السودان

Abstract

مستخلص البحث تناولت الدراسة طرق اختيار رئيس الدولة في النظم السياسية المعاصرة بالتركيز على السودان في مجال القانون الدستوري والنظم السياسية، وتمثلت مشكلة الدراسة في عدم الثبات والاستقرار الذي صاحب التجربة الدستورية منذ فجر الاستقلال وكل العهود الديمقراطية، وتظهر أهمية الدراسة في تتبع التجربة الدستورية ومقارنتها مع النظم المشابهة لها ومدى مقدرتها من تثبيت أركان النظام الديمقراطي، وتهدف الدراسة إلى التعرف على طرق اختيار رئيس الدولة في كل من النظام البرلماني والنظام الرئاسي، واستخدمت الدراسة مناهج بحثية وهي الوصفي والتحليلي والاستنباطي والمقارن وخلصت الدراسة إلى الآتي: إن النظام البرلماني في السودان لقد استمد أحكامه من الموروث الإنجليزي وإن مسألة الانتخاب المباشر تم بحثها بفائق العناية منذ أكثر من مائتين عام وقيل عنها أنها أفضل الوسائل نظرياً فقط. ولذا يمكن البعد عن النظام البرلماني في السودان نظراً للتعددية الحزبية وإتاحة الفرصة للنظام الرئاسي مع نظام التصويت غير المباشر في دستور السودان القادم.

Abstract

This research aimed at the ways of country's president selection in the contemporary political systems concentration of Sudan, in the scope of constitutional law and political system. The problem of the study represented on the instability which faces the constitutional experiment since the dawn of independence and all democratic regimes. The significance of the study appears on pursuing the constitutional experiment and comparing it with similar systems and its ability for stabilizing the democratic system. The study aimed the familiarizing ways of choosing a country president in the parliamentary and presidential systems. The used research methods, descriptive, deductive analysis and comparative. The study concluded with the following results. The parliamentary system in Sudan obtained it's rules from English inheritance. The direct elections issue has been researched with a high care, since than two hundred year and has already been said that it is the best theoretical practice methods and therefore we should not left adopt the parliamentary system is Sudan for the reason of the existence of multi party system and give opportunity to presidential system with the indirect election system in Sudan's coming constitution.
