Abstract

مستخلص البحث

ان موضوع هذا البحث هو حرية الراي والتعبير بالتطبيق على حرية الصحافة والنشر في النظام الاسلامي والنظام القانوني. وحرية الرأي هي حق الانسان في تكوين رأيه بناءا على تفكيره الشخصي دون تبعية او تقليد لاحد وان تكون له الحرية التامة للتعبير عن هذا الرأي بالاسلوب الذي يراه مناسبا وحرية الراي والتعبير بهذا المفهوم نص عليها في الاديان السماوية والاتفاقيات والمواثيق الدولية ودساتير الدول.

وقد تناولت حرية الصحافة كأحد وأهم تطبيقات حرية الرأي والتعبير وذلك لانها هي التي يناط بها التعبير عن الرأي العام وما يشغله من هموم ومشاكل سواء كان ذلك في الاطار السياسي او الاقتصادي او الاجتماعي.

والهدف من وراء هذا البحث هو التعريف بحرية الراي والتعبير والمظاهر المختلفة لها في القانون السوداني واستجلاء مواقف الشريعة الاسلامية فيها والتعريف بحرية الصحافة .

ومشكلة هذا البحث ماهو موقف الشريعة الاسلامية من حرية الرأي والتعبير وما هي قيودها في القانون وماهي حرية الصحافة وماهي قيودها الواردة في القانون.

اتبعت في هذا البحث المنهج الموضوعي والمقارن .

وقد توصلت الى عدد من النتائج والتوصيات .اهم هذه النتائج :-

النتائج:-

ليس هناك حرية مطلقة في القانون او في الاسلام وتتفق الدول في القيود التي ترد على هذه الحرية والتي تهدف الي حماية النظام العام والاداب العامة والاخلاق العامة وامن الوطن.

التوصيات:-

واهم التوصيات التي توصلت اليها ان يتم تحديد القيود الواردة على حرية الصحافة تحديدا واضحا في القانون لان الاصل في الصحافة الحرية والقيود انما استثناء.

Abstract

This research are include the freedom of opinion and the expression that by applying on the press and publish in the Islamic and legal system. The opinion's awareness are right for every human begin that upon to his personal thinking without follow or imitated to any one, and he/she have the perfect freedom to expression about his own opinion by his suitable and expression as general concept were based on the religion, the international agreement and promises also constitutions of the countries.

In this research I take freedom of the press as one of the important applies of opinion and expression, because pres are responsible to show problems of the publics political or economic or social.

Objectives of this research to definition of the opinion's freedom and according to the different forms in Sudanese law, also alienate status of Alshareea Al Islamia for it in addition to definition of the press freedom.

Problem of the research as follows:

What status of Alshareea Al Islamia to freedom of the opinion and what their condition in the law? what press's freedom meaning and what their condition in the law?

This study are following the subject and comparative approach .

This study are rich to some results and recommendation as follow:

The Results:

There is not absolute freedom in the law and Islamic, the countries are agreed to the conditions which are belong to this freedom who are targeting to protect the behaviours according to the national security.

The Recommendations:

The most important recommendation which are rich by the researcher that recommended to determine the conditions which are belong to freedom of the press and should be clear determine in the law without any exception.
