Abstract

The Restriction Upon & Enactment Upon the Wrongdoer((Saffih)) is a Research on Islamic studies carried out by Sadig Ibeid Elkibeesi and Supervised by Dr/Izz Eldien Mohamed Ahmed Omer . The Research is based on an interdiction, a conclusion and two other chapters. The interdiction treated the importance of the subject, the selection, methodology and Research proposal . The first chapter taked the preparatory study cited as ( The Fundamentals and Basics upon which the authorized organ is licensed to take the Restriction decision) the researcher dealt with (Islamic Concept of money),its value and position in life, the love of money is an_instinctive human characteristic which may lead or direct to illegal or twisted routes to obtain and spend money, therefore the researcher highlights this area which include the individual property , its quality, nature , restrictions ,and legal basis that reflected in Sharia and legalized as a general and private benefit interims of spending and enjoyment , and prevented when it tums into ways of instinctive full filaments based upon a Quranic base that the owner of the whole universe is a unique Alla (God) and that Man has the full right to make use of what upon earth on condition that not to deviate of deform that creation twist or miss direct universe. About the eligibility of Man , the researcher assured the necessity for qualities and conditions to own or deal with money unless he obtains the required conditions and characteristics mentioned above. For those who lost the eligibility should not be offered money and money should be put under the government control. In the second chapter “ The Restriction upon the wrongdoer and the enactment ” the researcher stated the concept of restriction, its meaning linguistically , legislatively and the articles and regulations . Then the researcher talks about the wrongdoer‘ behaviors and has classified it into three categories (l) worshiping behaviors. (2) personal status attitudes and (3) financial behaviors. In all these cases Sharia (Islamic Teaching) stands as a monitor to guide Man to words the good and benefits and to guard him against the badand losses.

Then the researcher states how and when to release these restrictions and whether the break of restrictions need a call of or an announcement when the wrongdoer (Saffih) claims good conduct and restore good behaviour and who is to be obeyed ¢ the judge the Mayer .All tentative solutions were being provided by the researcher at the foot of the research. The researcher came up with impotence of reminding the value of money and that the real owner of money is God ‘Allah’ are day Man will be asked about how he spent money and how he acquired it. Sharia call upon goreners to monitor and control markets, merchants and the whole citizens, to collects information about their behaviour and whether these behaviours adhere to Quraniceaching so as to be followed or stand against to be rejected.
