Abstract

مستخلص تناول البحث الآليات الدولية والمحلية لضمان مبدأ عدم الإفلات من العقوبة. تمثلت أهمية البحث في تناول الموضوع بأبعاده المحلية والدولية، وبصفة خاصة، موضوع الإفلات من العقاب والذي يمكن النظر إليه من وجهات نظر مختلفة، وفقاً لرؤية رجل القانون. هدف البحث إلى معالجة مسألة الإفلات من العقاب في جوانبها القانونية، والأخلاقية، وإدراك الآليات الدولية والمحلية لمناهضته، من خلال سياقات وتجارب دولية ، ورصد البناء القانوني لعدم الإفلات من العقاب في السياق السوداني من خلال (الدستور السوداني، القانون الجنائي)، وتحليل قاعدة إفلات الجلادين ومرتكبي الانتهاكات الجسيمة لحقوق الإنسان على مستوى الواقع، وعلى مستوى الممارسة، من خلال تجربة (هيئة الإنصاف والمصالحة)، اتبع البحث المنهج الوصفي والتحليلي. خلص البحث إلى عدد من النتائج من أهمها: إن الحصانة تقسم إلى نوعين: حصانة موضوعية تمنع المساءلة الجنائية عن للشخص المعني فيما يبديه من قول في المجلس أو في أحدى لجانه إلا في حالة التلبس في الجرائم التي تقع من قَبله، وهناك الحصانة البرلمانية الإجرائية التي تمنع اتخاذ الإجراءات الجنائية ضد الشخص المعني إلا في حالة التلبس، من ثم توصل البحث إلى هذه التوصيات الالتزام التام بما جاء في وثيقة الحقوق في دستور السودان الانتقالي لسنة 2005 والقوانين الأخرى وضماناتها وحماية الحقوق والحريات، ضرورة ذكر المواثيق والعهود والاتفاقيات التي صادق عليها السودان حتى تكون واضحة للطالب القانوني، يجب إيضاح غموض الكثير من النصوص أو قصورها أو عدم تطرقها لبعض الضمانات الهامة التي وضعتها المواثيق والاتفاقيات الدولية التي صادق عليها الكثير من الدول.

Abstract The research dealt with international and domestic mechanisms to ensure the principle of impunity. The aim of this research is to address the issue of impunity in its legal and ethical aspects, to recognize international and local mechanisms to combat it, through international contexts and experiences, to monitor the legal structure of impunity in the Sudanese context through (Sudanese constitution, criminal law), and to analyze the rule of impunity of executioners. Perpetrators of grave human rights violations, both in practice and in practice, through the experience of the IER, the research followed the descriptive and analytical approach. The research concluded to a number of the most important results: The parliamentary immunity is divided into two types: Objective immunity prevents criminal accountability for a member of parliament in the words of the Council or in one of its committees, except in the case of flagrante delicto in crimes committed by him, and there is a procedural parliamentary immunity Criminal proceedings against a member shall be prohibited only after the authorization of the President of the Council and also in the case of flagrante delicto, Consequently, the recommendations of the Sudan's Interim Constitution of 2005 and other laws and guarantees and the protection of rights and freedoms must be adhered to. The covenants, covenants and conventions ratified by Sudan should be mentioned in order to be clear to the legal student. Or not to mention some of the important guarantees set by international charters and conventions ratified by many countries.
