Abstract

Supervisor: Prof (Dr.) Yousuf Hussain Moha.'nrned Al-Basheer Summary: . The research has taken the study of establishing and dissolving public corporations in the Republic of Yemen. It was based on the analysis of the articles in the public Corporation's Law No.(35) for the year 1991, and its amendments issued by a Republican order (Law) No (7) for the year 1997, and its comparison with the Constitutional texts concerned with the establishment and dissolvent of public '. Organizations. The study is divided into three parts. Part(1) discusses the public organization and its status in the administrative Law, by researching the concepts of the public organization's elements of the Public Organization. The research has also discussed the establishment in the second part, the performance, reason for establishing the public corporations. We have adopted the direction awarding the constitutional authority, the right to establish Public Corporations, presenting the arguments against the opposing party, and also by studying and explaining the constitutional texts in support of establishing the Public Corporations through the constitutional authority. The dissolvent of the Public Corporations was discussed in part three the control of public corporations, and dissolving the public corporations. Findings: ,. . ~1- 2- The research come up with the result the Public Corporation's Law does not coincide with the jurisdictions of the constitution that organizes and dissolves Public Corporations. The Law has not considered dissolving the Public Corporation. Recommendations: 1- Giving the constitutional authority the right to establish public corporations.
