أثر جريمة الإتجار بالبشر على الدولة والأفراد (دراسة مقارنة)

Abstract

المستخلص جاء هذا البحث بعنوان (أثر جريمة الاتجار بالبشر على الدولة والأفراد) والذي تطرق إلى أهم المشاكل التي تواجه البشرية في العصر الحديث حيث أصبحت هذه الجريمة تشكل خطراً على حرية وسلامة وكرامة الإنسان فقد أصبح الإنسان سلعة تباع وتشترى، فلذا يهدف هذا البحث أولاً إلى معرفة الآثار المترتبة على هذه الجريمة، ثانياً معرفة الأسباب التي تؤدي إلى وقوع هذه الجريمة ولتحقيق هذه الأهداف تم إتباع المنهج الوصفي والمنهج التحليلي وكذلك المنهج المقارن، وقد تم تقسيم البحث إلى ثلاث فصول في الفصل الأول منه تم التطرق إلى مفهوم وأركان جريمة الاتجار بالبشر، والفصل الثاني تم فيه التطرق إلى الآثار المترتبة على هذه الجريمة، وفي الفصل الثالث سلطنا الضوء على الآليات الواجبة الإتباع لمكافحة جريمة الاتجار بالبشر، وفي الختام تم التوصل إلى عدد من النتائج منها تداخل مفهوم جريمة الاتجار بالبشر مع العديد من المفاهيم ذات الطابع الجنائي مثل مفهوم الهجرة غير المشروعة، ويمكن لجريمة الاتجار بالبشر أن تقع دون اتفاق جنائي مطلق ومن خلال النتائج تم التوصل إلى عدد من التوصيات نذكر منها تجب محاربة الأسباب المؤدية إلى هذه الجريمة والمتمثلة في الفقر وذلك عن طريق إيجاد حلول لأسبابه، كذلك يجب محاربة كافة أشكال الفساد المالي والإداري فالفساد المالي والإداري هي من أهم أسباب هذه الظاهرة.

ABSTRACT The title of this research (the impact of the crime of human trafficking on the state and individuals), which deals with the most important problems facing humanity in modern times. Where this crime has become a threat to the freedom, safety and dignity of man who has become a commodity for sale and purchase. Therefore, this research aims first to know the implications of this crime, and in order to achieve these goals the research followed the descriptive and analytical approach as well as comparative approach. This research was divided into three chapters, the first chapter deals with the concept and elements of the crime of human trafficking, while the second chapter deals with the effects of this crime. In chapter three, the research highlighted the necessary mechanisms to combat the crime of human trafficking. In conclusion, a number of conclusions were reached, including the overlap of the concept of the crime of human trafficking with many concepts of a criminal nature, such as the concept of illegal immigration. Moreover, the crime of human trafficking can occur without an absolute criminal agreement and through the results a number of recommendations have been reached, including the fight against the causes leading to this crime of poverty, by finding solutions to the causes.All forms of financial and administrative corruption must be combated. Since the financial & administrative corruption is one of the main reasons of this phenomenon.
