Abstract

لقد تناولت الباحثة في هذا البحث مفهوم نظرية أعمال السيادة ، حيث أن محور الدراسة السلطة التنفيذية وفقاً لمبدأ الفصل بين السلطات بمهمة تنفيذ القوانين والمحافظة علي سير المرافق العامة، كما تناول الباحث تعريف ومبدأ المشروعية وسلطات الضرورة (القيد الوارد على مبدأ المشروعية. مدلول ومصادر مبدأ المشروع . وأيضاً حوي البحث علي مفهوم أعمال السيادة ومعاييرها ودور القضاء.و موقف المحكمة الدستورية من نظرية أعمال السيادة، ونظرية أعمال السيادة في السودان ومصر. وإن الهدف من البحث هو أن يكون نواة لفقه قضائي وقانوني في السودان. وأخيراً تطرق البحث إلي الخاتمة والنتائج والتوصيات وأهمها: نشأت نظرية أعمال السيادة قضائية في فرنسا.لا يجوز في كل دساتير العالم الرقابة القضائية علي إعلان حالة الطوارئ الذي حول لرئيس الدولة.تجوز الرقابة القضائية علي لائحة الطوارئ .الرقابة علي أعمال السيادة رقابة سياسية يمارسها البرلمان. تفعيل الرقابة السياسية مع إعلان حالة الطوارئ .أن تعلن حالة الطوارئ في أضيق نطاق .أن تحدد المدة التي تستمر فيها حالة الطوارئ . ثم المصادر والمراجع.
