النَّظام القانوني لنقل المعرفة الفنيَّة (دراسة مقارنة)

Abstract

مستخلص تناول البحث النظام القانوني لنقل المعرفة الفنيَّة في ضوء قانون المعاملات المدنية لسنة 1984م مقارنة مع القانون المصري والاتفاقيات الدُّولية المنظمة لنقل التكنولوجيا وبعض التشريعات الوطنية فى الدُّول العربية والاوربية وتنبع اهمية موضع البحث من كونه يمثل الاساس لحفظ حقوق الدُّول المنتج والمستقبل للمعرفة، ويهدف الهدف الي بيان الاحكام المنظمة لنقل المعرفة الفنيَّةوالاثار الناشئة عنها، ولتحقيق هذه الاهداف إستخدم الباحث المنهج الاستقرائي الوصفي التحليلي كدراسة مقارنة تقوم على عرض النصوص القانونيَّة وتحليلها وومقارنتها بما هو قائم في التشريعات الوطنية ، واستعرضت البحث مفهوم نقل المعرفة الفنيَّة في القانون المصري والإتفاقيات الدُّولية ذات الصلة بجانب بيان أوجه حماية تلك المعرفة، وشروط المقيدة التي ترد في مثل هذه العقود والآثار الناجمة عنها ،كما عالج البحث طرق تسوية المنازعات الناشئة عن عقد نقل المعرفة الفنيَّة ثم القانون الواجب التطبيق عليها ، وتوصل البحث إلي مجموعة من النتائج من اهمها أن مصطلح المعرفة الفنيَّة يتميز بالغموض النسبي لذلك كانت محلاً لتعريفات مختلفة ، فلم تتخذ كلمة الفقهاء بشأن تعريف موحد للمعرفة الفنيَّة ، من أهم الخصائص المرتبطة بفكرة المعرفة الفنيَّة هي خاصية السرية التي تحيط بها كما أوصت الدَّراسة تنعكس النتيائج التي اسفر عنها البحث في التوصية باصدار قانون خاص بتنظيم نقل المعرفة الفنيَّة أسوة بالدُّول العربية التي سبقتنا في هذا المجال ، والوقوف على تجارب الدُّول النامية ونظمها القانونيَّة التي استطاعت تحقيق المطلب التكنولوجي.

Abstract The study addressed the legal system for the transfer of technical knowledge in light of Sudan Civil Code of 1984 in comparison with the Egyptian law and international agreements organizing technology transfer, in addition to some other national legislations in Arab and European countries. The significance of the study subject of the study lies in the fact that it represents a basis for the preservation of the rights of countries that create and/ or receive knowledge, the study aims to explore the provisions regulating the transfer of technical knowledge and the effects arising from this knowledge. Seeking to realize this objective, the studyemployed the inductive descriptive analytical approach as a comparative study based on presenting, analyzing and comparing legal provisions against existing national legislations. The studyinvestigated the concept of technical knowledge transfer in Egyptian law and relevant international agreements, as well as identifyingmeasures taken toprotect that knowledge, the qualifying conditions stipulated in such contracts, and the impacts resulting from them. The study also addressedways of resolving disputes arising from the contract of transfer of technical knowledge and then the applicable law. The studyproduced a number of findings, the most important of which is that the term technical knowledge is characterized by relative obscurity. Therefore, it was subject to different definitions, with no one agreed definitionamong scholars upon the term. One of the most important characteristics associated with the notion of ​​technical knowledge is the characteristic of secrecy surrounding it, as the study recommended. The findings of the study are reflected in the recommendation to enact a special law regulating the transfer of technical knowledge, following the practice of the Arab countries that have preceded us in this field. The study also recommended to consider experiences of developing countries and their legal systems that were able to accommodate technological requirement.
