Abstract

Abstract Thesis subject; this thesis consist of studying the (major basic rulizs of fundamentalism and jurisprudential) according to the famous book written by Sheikh Abu Bakr Al-Musanaf named as‘(Alwzuh— the Clarity), howevei this style of writing which followed by Sheikh Al-Musanaf continuously had aigreat impact on the Islamic jurisprudence in Kurdish areas. i The thesis is a collection of these mentioned basic rules which extracted from the (Alwzuh) book, and it's an attempt to rank and classify these basic rules according to the common fundamentalist curriculum, also representing examples for their applications that taken from the same book . \- Contribution in demonstrating the effect of fundamentalism rules and Jurisprudential in the science of jurisprudence and its assets, and the declaration of the importance of this science to enrich the Islamic jurisprudence, and its effect in facilitating the graduation of the multi branches of jurisprudence, even those studying the rules do not become a destination in itself. \'- It is known that the most important reasons for the difference between the jurists, is their differences in the fundamentalist rules, so the student of Forensic Sciences need to find out the methods and rules of the imams in the derivation, so as to be able to know the reasons of what the difference was signed first, And facilitate in front of him for tipping directory among the views Secondly, and so the phenomenon of fanaticism also will disappear. Thesis plan: thesis came in an introduction, an introductory chapter, and two parts, and the conclusion, contained major rules of fimdamentalism and jurisprudence cited by Sheikh Abu Bakr Al-Musanaf (may Allah have mercy on him), and through his book (Clarity), the division Was as follows: the introductory chapter: included four chapters, then a brief translation of Imam Rafii and Sheikh Abubakar Al-Musanaf (God's mercy upon them), and a brief about the book of Clarity and approach of the author and a brief about fundamentalist and Jurisprudential rules science, as definition and importance, and so on. Part I: the fundamentalist rules, contained four chapters. Part II: In the major jurisprudential rules, and contained five chapters.
