Item الحماية القانونية للعلامة التجارية على ضؤ القانون السوداني والقوانين العربية (دراسة مقارنة)(جامعة النيلين, 2020) نوال على موسى علىA b s t r a c t The research dealt with one of the most important topics of our time, namely the motives of asylum in accordance with international agreements and Islamic law. The study's problem was summarized in Sudan accepting large numbers of refugees, which is a developing country with limited capabilities and capabilities, the presence of refugees in Sudanese cities, and their participation of citizens in public services provided by the state to its citizens. The importance of this study lies in the fact that it deals with the exposure of refugees to many human rights violations, and they may not have suffered or felt suffering from violations of their rights in their countries of origin. This study aimed to demonstrate that the issue of refugee rights has become a sensitive nature, and can be used to interfere with the sovereignty of states, given that the original country of a refugee, or the host country, does not protect global peace and security. This study was divided into an introduction and three chapters according to its purposes, where the first chapter dealt with the general concept of asylum, its historical development and its sources, the second chapter talked about the legal status of a refugee in the country of refuge, and the third chapter dealt with the types of asylum, its effects and motives. The research reached a number of findings and recommendations and the most important results: The legislation and laws that regulate the matter of asylum in Sudan have a lot of indulgence, which facilitates the presence of large numbers of refugees. As for the most important recommendations: Finding Arab regional legislations that include concluding agreements related to refugees, regulating their legal status, guaranteeing their rights, searching for clear and specific mechanisms to deal with refugees, and activating international legislation in this field, ensuring a balance between the rights of the refugee and the ability of the host country.Item الضمانات القانونية لحمايـة حقــوق العامـل في القـــانون والاتفاقيات الإقليمية والدولية(جامعة النيلين, 2020) الطيب الزين موسى آدممستخلص البحث يتعلق موضوع هذه الدراسة بالضمانات القانونية لحماية حقوق العامل في القانون والاتفاقيات الإقليمية والدولية، وتستهدف الدراسة إلقاء الضوء على الضمانات والحماية القانونية التي كفلها المشرع السوداني لحماية حقوق العمال بشكل عام وللمرأة والأحداث العاملين بشكل خاص، ومدى كفايتها من الناحية العملية، وكذلك التعرف علي أهم المشكلات التي تعترض ذلك والقيام بمناقشتها. وقد اتبعت في هذه الدراسة المنهج الوصفي التحليلي ،وقد احتوت الدراسة علي أربعة فصول تناول الفصل الأول منها تكوين عقد العمل وعناصره وتناول الفصل الثاني الضمانات القانونية لحماية حقوق العامل ،وتناول الفصل الثالث الآثار القانونية لعقد العمل ،كما تناول الفصل الرابع منها انقضاء عقد العمل والضمانات القانونية الخاصة به. وتوصلت الدراسة إلى أن العمل الذي يخضع لقانون العمل يشترط فيه أن يكون خاصاً، ومأجوراً، وتابعاً، وأن المعيار الذي يميز عقد العمل عن غيره من العقود هو علاقة التبعية القانونية ، وكشفت الدراسة أن المشرع السوداني لم ينظم الأحكام الخاصة بالإضراب وأثره في إنهاء عقد العمل، ولم يحدد بدقة العقوبات التي توقع علي العامل وضانات توقيعهاعند إخلاله بالتزاماته التعاقدية كما فعلت بعض التشريعات. ولما تقدم يوصي الباحث بوضع نصوص تشريعية تحدد بدقة العقوبات التي توقع علي العامل ورب العمل عند مخالفتهم لأحكام قانون العمل ،والزام كل صاحب عمل بوضع لائحة لتنظيم العمل بمنشأته خلال ثلاثة أشهر من تاريخ افتتاح المنشأة علي أن يشرك في وضعها ممثلي العمال،والا تكون سارية إلا بعد إجازتها من مكتب العمل ،ووضع نصوص قانونية تنظم أحكام الإضراب وتحدد ضوابط ممارسته بما لا يخل بالتوازن بين مصالح أصحاب الأعمال، والمطالب المهنية للعمال. . ABSTRACT The topic of this comparative study deals with the legal guarantees for the protection of the worker’s rights in Sudanese law and international conventions. The study aims at shedding light on the guarantees and legal protection guaranteed by the Sudanese legislator to protect the rights of workers in general and of women and young workers In particular and their adequacy in practice. Also, to identify the most important problems encountered and discuss them. I have followed in this study the c descriptive analytical approach. The study includes four chapters, the first chapter dealt with work contract formation and its factors, the second chapter consisted the legal guarantees for worker rights protection, and the third chapter has tackled the legal impacts for working contract, as the fourth chapter included the termination of working contract and its private legal guarantees.s The study reveals that the work subject to the labour Law requires that it should be private, paid, and an affiliate, that the criterion which distinguishes the work contract from other types of contracts is a relationship of legal subordination. The study also reveals that the Sudanese legislature did not regulate conditions for the strike and its impact on the termination of the employment contract, nor did he identify precisely the penalties upon worker and assurances regarding disciplinary actions of contract commitments as some of legislation did. Based on the above, the researcher recommends that legal text should be done so as to determine the punishment for worker and employer accurately when they abuse of working law texts, furthermore employer must put list for working organizing in his facility during three months from the facility opening, workers' representative should contribute in its making, and can be invalid except after its authorization from labor office, also making legal provisions governing provisions of the strike and controls exercised without prejudice to the balance between the interests of employers and the professional demands of the employees.
