    المستخلص يستقصى البحث دراسة حدود التزام البنك بالسرية المصرفية والاثر القانوني المترتب عليها وتاتى اهمية هذه الدراسة البحث فى التشريعات المقارنة التي تهتم بالسرية المصرفية. وتحقيقاً للهدف المرجوا من هذا البحث استخدام الباحث المنهج الوصفى التحليلى المقارن املاً في الوصول الي الحقائق العلمية ، وقد تناول الباحث فى هذه الدراسة مفهوم السرية المصرفية ، وتكييفها ، ونطاق التزام البنك بها ، والاثر القانونى المترتب عليها فى حالة الكشف عنها. وقد توصل الباحث الي نتائج اهمها ضرورية الالتزام بالسرية المصرفية من قبل البنك ومسالة موظف البنك فى حالة افشائه للسر ، وقد تناوله الباحث مفهوم السريه المصرفيه فى التوصيه بتوسيع دائره العقاب على كل من يفشى السر المصرفى ، و النظر فى تحديد موقف الشخص المعنوي وتقدير العقوبة الملائمه له. Abstract This research study explores the limits of the banks commitment to bank secrecy as the legal and the impact on them the importance of this study research in comparison legislation bank secrecy to achieve the goal of this research.The researcher used the descriptive analytical comparative. The hope of acess to scientific facts is his goal. The researcher is addressed in this study the concept of banking secrecy and it is adaption and the scope of the banks commitment the legal and the impact in the event disclosed. The researcher obtained the following results. Necessary commitment to bank secrecy by the bank and the issue of bank employee in case of spilling secretary. The researcher dealt with the concept of banking secrecy in recommending widening the punishment on both disclose secrecy bank account.and to consider in determining the person’s moral position and report the appriate . punishment for him
